So I need to basically complain now, and not just sit on it for a while until needed?2 -
Your ICO complaint is totally separate from any claim you have outstanding. It may be that once you have started your complaint that the person handling your case at the ICO may advise waiting until after the outcome of any legal action before continuing with your complaint.
It's a few years since I successfully complained about a GDPR breach that also involved a court case (nothing to do with parking) and I vaguely remember something about being asked whether there were any court proceedings connected with the complaint.2 -

(a) complain to the BPA and your MP to lean on CEL, or
(b) sit on the letter for now and append it to your Witness Statement to support an argument for full costs for wholly unreasonable conduct.
Also, please show that to the Government as part of your response to the Public Consultation when it opens, to make the point that the added £70 unjust enrichment MUST STOP because it incentivises aggressive litigation like this, and misleading demands.PRIVATE 'PCN'? It's maddening because there's the urge to scrawl COUNTY COURT DEEMS A LIE across it, and send it back. A pointless exercise though no doubt.1
