OPs friend has been posting on Landlord zone since 12 January about this issue.
The information given over there differs from the information shared on here.
    I’m out.
Shame all that information was not shared at the start, it would have explained an awful lot and saved a lot of time.

It's so confusing as she's been there a year already and was paying by SO, so why have they not now continued, why is she phone to pay or offering cash? Is she trying to pay to stop any action against her, as in pay more than her rent?

Oh and she had savings, where they locked in the same bank. Where was her wages/benefits going in all this time?

Was it really fraud or was it a scam and she sent the money over herself.

So the LL wants her out due to no income. I wonder if the LL has a claim against the crap agency who didn't correctly screen her.

  • Either the OP is having some Mitty issues (maybe Sarah), or they have a really bad choice in friends.

But as they also appear to have CIFAS markers (which isn't surprising, considering they appear to have had problems with the majority of the high street banks) I'm guessing that they might be the kind to live in a soap opera.

The letting agents told her to contact a company to do breathing space

the man on phone told her it’ll last for 2 months and they can’t carry on the posession proceedings ?

is this correct so I can let her know ..

    as per it says online

“A standard breathing space is available to anyone with problem debt. It gives them legal protections from creditor action for up to 60 days.”
But she doesn't have a problem debt - you told us it was all resolved and she had full access to her accounts and was paid up to date ??

So what's the full story ?
They’re telling her to do this breathing space thing so the landlord stops proceedings
so that she can find somewhere else

is it 60 days they can’t do anything for?
Breathing space will not stop a section 21 and the landlord can still apply to the court if she doesn't move out. A section 8 for rent arears cannot be served whilst a tenant is in breathing space
