    You can’t actually apply for breathing space as it’s your debt advisor who has to apply for it. I’ve not read the whole thread but it seems like your friend was just two months late due to fraud and has since paid these arrears. I’m unsure why she would have a debt advisor in this scenario. 

    Assume there is something else going on here. Which may help to explain why the landlord is so keen to evict her.

    I don’t see why this applies to the OP’s friend as they’re not in debt. 
    I suspect it depends what the debt advisor was told! If told that a) rent was owing and b) there was no money to pay that rent, then the adviser may have granted breathing space.

    I have no dea how much access they have to the debtor's finances or what checks they make, if any....

    The letting agency advised her to do a breathing space ?!? 

    and that’s what she has done!! I’m only going by what she’s telling me 

    Also she asked me to ask would they still be able to do the posession thing or would it be paused for 60 days due to the breathing space. 

    She’s driving me insane…

    Sounds like your friend has a lot of debt and possibly lied on her application form about her financial situation.  The landlord has now found this out and has decided to start eviction proceedings.  Breathing space just gives a temporary hold and I think it was a mistake for your friend to utilise that device.

    Since on the face of it there appears to be no debt, then breathing space will not be required/allowed. 

    Even if there was debt, then assuming (from the date that you first posted) the notice was deemed received on 20th (possibly 21st), then were I the landlord and seriously wanted them out, I would have sent the application to the court either Friday or today, and it could already be too late to ask for breathing space. 
    Credit card debt - NIL
    Home improvement secured loans 30,130/41,000 and 23,156/28,000 End 2027 and 2029
    Mortgage 64,513/100,000 End Nov 2035
    2022 all rolling into new mortgage + extra to finish house. 125,000 End 2036

    Stop enabling her and tell her to come here herself. Problem solved. 
    This is the best piece of advise I've seen on this thread so far. The OP is getting a battering for trying to help out a friend (and I do believe the OP in genuinely trying to help someone out) but it's got to the point where it reallty should be the friend standing here constantly asking "Are you sure??"

    Update they wont let her join. 🙄🙄🙄🙄 

    she’s properly annoying me with all her drama now and I’ve just told her straight over the phone. It’s annoying me😵‍💫 

    so with regards with the answer the letting agency has told her to do breathing space , would this pause the proceedings for 60 days? 

    They’ve told her yes it will and when she’s read online it isn’t very clear it just says yes it does then it’ll resume after .

    i honestly do not know why the LA has asked her to do breathing space … 

    mind boggling 

    and I’ll most definitely be cutting ties with her after all this
