Easy done in such a long threadRobbo66 said:
Ah I missed when the tenancy started when I posted_Penny_Dreadful said:
It’s too early for the landlord to serve a Section 21 because the fixed term ends in November. Any Section 21 served now wouldn’t be valid.Robbo66 said:Any agent or landlord worth their salt would have served a Section 21 alongside the section 8. If the section 8 fails or becomes void they can then fall back to the Sec 21. Also re the G17, G 12 would have been a better option, still discretional but a better bet.

I take on board your comments however this is still under investigation and I can’t comment further until the investigation is completed. Please bear with us whilst this takes place.
Is this possibly because your friend, whose income is a grand total of £390 a month, is somehow renting a property with a rent of £1,250pcm?

why did she need to speak to someone before paying?Standingstrong said:
She rang agents today and asked to speak to the women and they said not in till tomorrow and she said to the man on the phone can you tell me more please and he said no got to wait Until that girl is in office tomorrowsaajan_12 said:
The rental statement is good practice, to show the court the LL has done everything before escalating to court and incurring the fees etc. However its not 100% required and as long as the LL can prove the 2+ months arrears, they will get a possession order.Standingstrong said:She’s gone through her notice papers and they haven’t included the rental statement ? Does that mean notice is valid ?
and when she pays off the arrears in full this week will the notice expire? as there is no arrears
she’s going to pay December January and February so basically 3 months rent this week
The issue is if friend really wanted to pay rent on time, then they'd have paid it as soon as the account got unlocked. Was that really *today* since you mention she can now pay the arrears? They wouldn't have waited for the notice or to write a letter, or just for this week to start.

Standingstrong said:Right the rent was not paid because HER BANK ACCOUNT . Got shut for fraud and all her Funds got taken hence why she couldn’t pay the rent. The landlord and estate agent knew about this.
The estate agents colleague emailed her today and said wait for the girl who’s dealing with this to come in tomorrow so that they can talk and sort this out.Does that now sound a bit better? How long has she had access to her bank account back? That was the day she should have paid the arrears, that is what everyone is saying not that she didn't have access in the past.Surely she doesn't phone every month to pay the rent, she should have paid the rent them spoken to the LA about the notice.**yes I know I've come in too late to the party**

@ayupmeduck see OP's earlier post - arrears are now paid0 -
Long thread so I may have missed it, but...Standingstrong said:
First bit was about paying rentEssexHebridean said:It's difficult to say, without knowing the other side of the conversation.
second bit was about the false info to gain tenancy
do we know what information which was allegedly false was given to gain the tenancy? And presumably this is the aim of the 'investigation' that is ongoing yes?1 -
I might have missed it but I don’t think it’s been mentioned what the false info was about. No clarity on the investigation either. All a bit of a nothing in the end tbh. The ‘empty house across the road’ one was better!Shout out to people who don't know what the opposite of in is.3

You can't expect the OP to know all the details. After all, she is just 'asking for a friend'.No free lunch, and no free laptop

Bit of bad news the Landlord still wants posession0

The landlord is presently of mind to commence possession proceedings upon expiry of the notice. If you intend to make a rent payment, that would be received gratefully. The payment details are as follows:
