Non - delivery by royal mail

Options
I ordered a M&S gift card to be sent to a relative on 02 Dec - I paid an extra £3.50 for 48 hour delivery
Of course, due to strike action by RM - This has still not been delivered
What are my rights for a refund of the £3.50 ?

If I was half as smart as I think I am - I'd be twice as smart as I REALLY am.

Where did you buy it from? Have you asked the supplier for a refund?
  • Depends what M&S have specifically promised when they sold you the upgrade and what the T&Cs say. Have you asked for a refund, I'd imagine a company like M&S would probably refund it?

If you paid for a guaranteed 48 hour service then you should be entitled to a refund if that failed.

However, if it was something like Royal Mail tracked 48 then the 48 hours is only an aim and not a guarantee.

The OP won't have specifically paid for any RM service though - it's an additional payment to M&S to upgrade the delivery service.  M&S will then have paid RM for a service but there's no relationship between RM and the poster in that case. So it comes down to specifically what M&S have promised rather than the specifics of the post service. (Assuming the card was bought from M&S)

Where, not how - from M&S? Or a third party?
  • But my contract is with M&S to get the card to the recipient by whatever method they choose
M&S chose to use RM rather than the myriad of alternatives

  • There are no "OBVIOUS" terms and conditions on their website
