    But the point is... it will be six weeks this coming Monday since you told us on 16th October that you have to file a Defence.
    Check again your documentation... did the set aside Judge give you a deadline for filing a Defence?

    It says: The Defendant shall file and serve a defence within 28 days of being served with the claim form and particulars of claim

    i have sent the defence to the Court but didn't to the claimant

    sent to court 2 weeks after been served with the claim (they have send me on my email)

    The deadline for defence was 28 days from the claimant to serve the claim.
    DCB exceeded their term (14 days) to serve the claim (i had to wait until the last day). On 15th day i have contacted DCB and reminded about the claim. Same day they have send me and email with the claim. It took me 2 weeks to adjust template on mse according my case. It does takes long time to read local threads. + doublechecking + doubts + redo the letter+ again redo the letter+ again 5-6 times.

    I think this letter is very typically for the case (from what i have noticed)

    If they failed to submit the claim within the 14 days specified by the judge, you should have been asking the court to throw the claim out, not telling them you want them to make a claim against you.

    You can still send a draft court order asking for the case to be struck out for failing to comply with the previous order, but it would have been so much better to do that before they issued the claim.
