Have agreed on child support to be paid independently by ex dh rather than through CMS. 
This will be back paid to the date that he left. It is less monthly than would be granted through CMS, but works out as just a wee bit less over the 2 years as this will be backdated but the CMS claim wouldn't be. 
It is also being written into the financial agreement that will go before the court as part of the divorce.

All sounds positive and a bit of progress. 

One thing to remember - even if you have a private agreement on child support you can still go to CMS at any time and get an award for what is due. Once the other things are resolved I would probably recommend that you do that as you will a) get more money and b) have a lot more options for enforcement if he decides not to pay and c) will avoid running into problems of starting a new CMS claim later if he does decide to do a disappearing act again.

Even if the child support is written into your consent order then I think it only lasts for a year before you can go back to CMS.

Thanks TAG. I am content with this for now. It will be backdated whereas the CMS wouldn't be. I think this is my best bet for now. 
Good to know that I can go back to the CMS at a later stage if need be. The claim has completely been stopped now anyway so would have to start again.

Hi all. Just an update for those who were so helpful and supportive when I needed it most. 

I am now in receipt of a regular monthly payment as agreed and have also just received all the backdated money that was promised. Came at exactly the right time when I am needing it most.
