No address for ex, therefore no hope of maintenance.

  • So you will have to ask the courts, as he is on bail he can't be using your address with the police / court so ask them to disclose to the CMS.

  • The police know he is still using our address but they can't do anything about it. They have spoken to his solicitor but he is not being helpful at all. 
    The CMS wrote to his employer and asked them to pass along the letter but still have gotten nowhere. 
    I'm hitting a brick wall at each turn. Don't get me wrong, I am working my butt off and am quite independent but he should be providing for his child and he isn't. 
    I can't even apply for a divorce as the online form won't let me get past the address bit. 
    Also want to change my name by deed poll, but if you are still legally married you have to inform your spouse.

    I suggested earlier that you use a tracing agent? You clearly have a lot of info about him, including his place of work, name, and his car reg, so this would probably be a very simple process. It's not as if he's vanished without trace.
    Why did you wait a year to claim the SPD on your council tax?
    If he is using a false address with his employer then I would make sure that you inform them of this.

    I agree doing that from the beginning would have given you some proof that you had informed someone official  that he'd left the property. It would have also helped you financially by knocking 25% off the bill. 

    As it is CT records will say that until recently he officially still  lived with you, and he's not changed his address anywhere either so I can see why CMS are getting stuck. 

    As he was removed from your property I'm guessing you have something official to that effect? I'm wondering if when you receive any letters from him such as you have, you write to them including the evidence about this so they know he can't be at your house and then make steps to find him, which might make his address come to light. 


    How long will the CMS keep the case open for you to discover his address?  I'm assuming that at a later date they'd re-open once you become aware of his new address? Not that helps you currently. 
  • I didn't claim the SPD before because I didn't realise I could. To begin with my eldest daughter was still living at home but she has now moved out and is paying her own council tax. So I would have been eligible for the past 6 months. 
    There is evidence that he moved out a year ago as all the letters from the court are still coming here, addressed to him, with the conditions clearly stated that he cannot come to the property. 
    Not sure if it would do any good for me to contact his employer as CMS have already officially done that. 
    CMS have told me that they close the case after 6 months, but will reopen as soon as I can give them any new information. 
    Things will come to a head in the next few weeks so I may get somewhere then. 

  • And before anyone asks, it is odd that the court letters come here, addressed to him. I imagine that they are doing this for my information. I only know because I open all his post. 
    Mostly they are speeding or parking tickets. Or documents from DVLA, car insurance, medical insurance etc. Everything that normally wouldn't be online.

    Ring the car insurance.
    Tell them your ex doesn't live there.
    If the details of the court order are in the public domain I would tell them that as proof.

    I find it hard to believe that he is out on bail and given the police a false address and there is nothing that they can do. 

    You can apply for the divorce and have the papers served on him at work if you know that address. Equally you can ask the court to dispense with the need to serve papers if there is no way of finding an address for him. 

    I feel like you probably need to get some advice at this point as it seems like there are a lot of routes that you could go down but aren't getting the right responses or information. Have you tried Citizens Advice, women's groups and spoken to a solicitor?

    I doubt he has given the police a false address. They obviously know he isn't living here. But they can't give his address to me because they wouldn't know what I would do with the information. I understand that. 

    I can't ring his insurance company. It's quotemehappy if anyone can find any kind of way to contact them. Only phone number I can find is a claims line. Everything else asks for username and password before you can get anywhere. I did use the GDPR contact form to ask them to take my name and address off their system. Haven't had a response.

    You should be able to talk to a solicitor for an initial consultation free of charge. You'll get an hour maybe but it should be enough for them to give you a steer as to what is possible and not possible.

    The police won't give YOU his address no, but they can be asked by a court to provide it to the court I would think. This is why I say you need to get some proper advice. You asking for the address is not going to get you anywhere - you need to pursue it in the right way through the right channels.

    Same with the divorce application.
