No address for ex, therefore no hope of maintenance.

    The quotemehappy fraud one is something I hadn't managed to find. Will do that today.

    Not sure exactly what I should be speaking to a solicitor about. 
    When I spoke to them before it was about getting a non-molestation order and occupation order in place for when his bail ends. I've been told that I shouldn't do that while the bail is in place as it protects us.

    Speak to a solicitor about exactly the issue you have raised here - that you want to pursue a claim for Child Maintenance and get a divorce but you don't have his new address and you don't know what to do.

    Sometimes you just need someone to guide you to the obvious because everything has been going around in your head for so long. 

    We have an employee assistance programme through work so I will give them a ring and see if legal advice is something that they offer.

    I am really surprised that they don't class as writing to him at work not good enough especially as the CMS now use the HMRC details to prove income which would also prove the work address is correct. I would talk to CMS and ask them why this is not good enough. It certainly used to be when they were the CSA.
    I think the CMS are fobbing you off, I would ask to speak to a supervisor and raise a complaint.

  • The problem is that they can send the letter to his work but that does not prove that he got it. 
  • Have you tried contacting his employer and telling them you need to get a letter to him and will they ensure he receives it? So rather than just send it to him at the address it actually goes through HR or something and there's a record of it.

    But you could say that about any address including if you found out where he was. I actually think it would be a lot harder for him to prove he didn't receive a letter at work than an 'unofficial' address if you found out where he is staying. 
    Speak to the CMS again, like i said earlier sending a letter to a work address used to be perfectly acceptable

    Someone mentioned using a tracing agent. Not sure what kind of cost would be involved. 

    AFAIK he has not told anyone his address. The only one of his friends who knows for sure that he no longer lives at home, is not forthcoming about where he is now living (his wife is my best friend and gives me any little bits of info). I have previously passed on an envelope of letters to give to him (which had come in the post); a few weeks letter I got the envelope back unopened. 

    So now I open his post, either bin or return to sender, or contact the relevant company to update their records.

    If you send a letter to HR and they confirm that they received it and passed it on to him that's evidence that it was received. They won't give you his details no of course not. But they can certainly help you get a letter to him. They may say no, in which case fine. But if you go to a court they are going to ask what you did to try to make contact and if you haven't at least spoken to his employer than they may feel you haven't made sufficient attempts to contact him. 

    I really feel like you need to get some help with this - try Citizens Advice maybe?
