    Good point about the N159.

Are Cardiff on the list for the pilot of hearings on the papers...I think they might be?  Maybe the Judges there are throwing their weight around to take advantage of the pilot to close down defendants from being heard - sadly it has never been a good court in our experience.
That is more likely the reason; I do seem to recall Cardiff being on the list.
  • Yes I believe Cardiff is on the list unfortunately. Looks like I'm probably scuppered then so I need to make sure I cover all likely arguments from the claimant in my witness statement and evidence. I've not received theirs yet. Still writing mine but will share it when Im finished.
  • Here's my witness statement, I'll post the evidence in the next few posts because it doesn't seem to want to put them in order!

I did an SAR and they have sent back a photo with the badge on the dash but the badge was closed. I hadn't realised, will this be a problem? The fine wording is "parking in a disabled person's space without clearly displaying the expiry date of the disabled person's badge"
Just playing devils advocate here... You quoted the above early on in this thread after you received the response to your SAR.  What are you going to say to the judge, if asked, "was your blue badge open and displaying the expiry date?".

I am not even sure if it is a problem but I though it best to highlight this, at this stage. No doubt the experts with much more legal knowledge will comment.

    It’s a hearing on papers.
  • I personally don’t see it as an issue, PCN should have been cancelled at appeal.
