This operator has very badly maintained, scruffy car parks, On this forum we have seen pot holed car parks which when fllooded the white lines were not visible, Ticket machines that eat coins, poor signage and signage that was covered in graffiti.
Motorists that have defended their claims have either won or the claims been discontinued. Judges are usually fair when the motorist has paid and the ticket has fallen off the dashboard. Some judges have said that the PPC should have tickets with adhesive that will stick to the windscreen.
Reply from MP with correspondence from IPC via MP today:
Oops you didn't even appeal so we sent to debt collectors. You were in the wrong but as a gesture of good will, we'll cancel 1 charge (12th Aug). We have a 4" 5" sign.
I replied today stating ideally I want all charges cancelled, but if they do cancel 1, to cancel 6th Aug 2022. Stated about poor signage with tiny font, unreadable even up close, and attached evidence, and also evidence of 24 hour ticket (covering 12th - 13th).
Hopefully my case worker forwards this on and IPC cancel them all or at worst, cancel the 6th Aug 2022 ticket which was the 35 min overstay.
Who is your "case worker"? You may not want to draw attention to a particular PCN by agreeing to one being cancelled but you'll defend the others when offered such. Whilst the bottom-dwellers may be intellectually challenged, they are quite able to latch on to something like differentiating between your PCNs.
The 4-foot by 5-foot sign at the site was mentioned in IPC/PPL's response (referring to the huge "paid car park" sign on the site). Which they said was clear enough, since I paid both times; and attached a bunch of close-up images of their tiny A4 signs too,
However, the actual 'T&C' information is tiny and unreadable even when I am directly below it, and posted on white A4-sized plaques. No way motorists can actually see this unless they specifically go looking for it and take a zoomed photo. Secondly, it blends in with all the graffiti on-site.
I have already replied, and my MP/case worker told me that the reply was forwarded on to the IPC, so I am waiting to hear back.
Gladstones should have contacted me by now regarding the "next steps" and 'legal proceedings, but I have not heard anything back (although I did make them aware that I contacted my MP, and was writing to the landowner). I don't know if they've already applied this "gesture of goodwill" or what is going to happen. I just wait~
