If this goes to court, do I get to 1. Choose the court date, 2. Need to write my defence as driver (or do I continue as registered keeper?) I wasn't really sure after reading the post.1
-
1. You give the court a range of dates when you are not available, but the court will select the date of the hearing, working around those dates. I presume you know that the court will be one close to your home address (not the Northampton CCBC!)
2. You write your Defence using the Template Defence provided on the forum, you just need to add a couple of opening paragraphs. We recommend that if you were the driver, you confirm that within the Defence. A Judge is not someone to be evasive with, trying to find a PoFA 'loophole'. You can be sure that any sidestepping around this will quickly elicit the question from the Judge 'Were you, or were you not the driver on the day?'Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hello,
I have received all photos and PDT information from them now.

What have you spotted that's useful? Are the machine logs helpful?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

PDT:
One of them shows payment record covering the entire period for which 2 pcn were issued (flipped ticket - the contravention was that a ticket not displayed)
The other one shows payment record covering a period which expired 35 minutes before issue of 1 pcn (contravention- expired ticket)
I had to ask twice for the PDT records as they were saying that PDT machine records were irrelevant to my cases, due to one ticket being expired and the further 2 were flipped meaning it wasn't on display on the windscreen showing date and time details as per T&Cs.
Photos show timestamped images of my car
They've also provided pdfs of issued NTKs, and 1 photo of their poor A4 signage which isn't even readable on the photo.1 -
I haven't heard anything back since I received the evidence from Premier Parking, is there anything I need to do in the meantime? Can I tell Gladstone Solicitors through the portal that I have evidence for payment (ticket/PDT) for 2 of the tickets(?)0
-
How is evidence of payment helpful to either PCN accusation? One is for a fluttering ticket and the other for stating past the paid-for time. I don't think it assists.

Regarding the expired ticket are you sure that it was an overstay as there has been numerous issues with ticket machines on these car parks.
Motorists have been ticketed for overstays when they thought that they had paid the correct tariff. It would seem that the ticket machine was not calibrated properly and was eating some of the coins.
I can't see how a contract could be formed from the entry signage. There is a fair bit to work with on a defence against this notorious ex-clamper.

@SilverTeddy11 - have you written to your MP yet?
If not, I can recommend a website called writetothem.com - this is a free service that lets you write to your MP by email and can remind you about follow ups.
It lets you find MPs, so you could find the names of your MP and the MP for the constituency where the speculative invoice was generated for: I don't remember it allowing you to CC in a second MP, but you can always send a separate message and mention that you've contacted your MP and asked them to liaise with them and this is just a copy for their reference.
I've used it myself in the past, and this post is #NotSponsored6 -

The signage is so tiny, I never actually noticed it until I was looking for it specifically after the tickets were issued.MothballsWallet said:@SilverTeddy11 - have you written to your MP yet?

I've used it myself in the past, and this post is #NotSponsoredI've already written to 3 MPs. I got a reply from 2 saying they only deal with matters from people from their own constituency, and I got an automated response from the MP from my constituency.
