As I said, its mandatory now, for. BOTH. sides, its also a recent change so most people will have no experience of them, myself especially

They are not designed to help, but the mediator will try to obtain a compromise that both parties will accept

Typically the Claimant will want most, or more likely ALL of the amount claimed on the claim form, you won't want to pay a penny, neither side will agree to a compromise, mediation over, it goes to the local court that you nominated, therefore follows the old track. ( Think of it as a mandatory hurdle that you can go around by offering nothing. )
    Fair enough
Will this likely go to court then?
The case files will, then your nominated court will continue the standard process

Will it go to an actual hearing or not. ?  Nobody knows, because that would require the whole match to be played, plus the claimant paying the local court, bundles to be prepared and submitted by both sides, a case slot to be found for the hearing itself, people to be appointed, the whole shebang. ( Or it could fizzle out for any number of reasons, like the almost 400 in the discontinuations thread by Umkomaas. ) even the prophet Nostradamus or the late mystic meg cannot predict the outcome here.

Take it as it comes, one step at a time, instead of trying to predict the future

Read the Mediation Mary thread.  Search for it.  That one will prepare you if the Mediator is unreasonably biased. If you feel they are then SAY SO and then end with the words I said.

Just read it. I now know is going to be a waste of time 😂😂

Are those mediators been paid by the court? Why dont they side with us and side with the scammers? Dont get it!!!!!

When I get the call, will just explain my situation. They will probably asked me to pay a reduced amount, I will politely decline and at some point the conversation will end. What a waste of time 🤦🏾‍♀️🤦🏾‍♀️
Mine is booked for the 2nd week in September, will let you know how it goes 👍🏾👍🏾

  • So guys, just finished my mediation
    Lasted 40 minutes
The mediator started introducing himself and state the purpose of the call. DCB will not be hearing me nor I will be hearing them but they were on the line at the same time
Anyways, he asked me for my version of the story which I gave. He then stated thay for the purposes of the mediation DCB legal had counter offer from 596 to 440.
I stated no, I will be not paying that andmy first counter offer was of 12 pounds. The amount I owed the hotel. They came back saying that I had 2 parking tickets so they stated 350. I stated that I had 2 parking tickets because I stayed there for 2 nights. If i had stayed for 1 week, would they be asking me for 2k?! So their final offer was 150 pounds. My partner was with me and he reminded me that I am pregnant and that we didnt need this stress at this time so I saod ok, I will only pay 100. They accepted the offer. I am still a bit angry but I guess I do not this right now. Is upsetting due to the hard work I put it from the begining sorting this oit but priorities.
The mediator then read the contract and stated the points. Among others I have 28 days to pay the 100 pounds or DCB can claim this money back or the full amount. Once the amount is paid, should be settled.
Receieved an email from DCB with their bank details and I quote at the end "Failure to make payment may result in the matter progressing to the next stage" i
Next stage? Surely the claim will be settled once the payment is made so will need to confirm that
Anyways, I just wanted to let you guys know. All I can say is sorry

What a wast of £100 when all you had to do was offer £0 and the mediation would have been over in 5 minutes and then the claim would have eventually been discontinued as per the over 400 other DCB Legal claims we have evidence of.

If you'd persevered and wanted to waste some money, you should have just kept bartering as we know that DCB Legal will go as low as £25 for anyone who insists on paying them anything.
