Thank you. Requesting that contract might be useful for me, as I’m one of the ‘fluttering ticket’ cases. It could poke holes in what they’ve been asked to do by the land owner when I get my defence together.Fruitcake said:It looks like a letter before/of claim giving you 30 days to respond after which they will issue a claim.
It is up to you how you respond, but you are not required to fill out their forms.
You could fill in part of the forms, for example Box I only, requesting the contract with or flowing from the landowner that they intend to rely on in any claim.
Never give a 'phone number, ever.
You can if you want more time send a 30 day hold instruction. If you want to do this, then send it around day 25 from the date on the letter above.
State that whilst you deny the debt you are seeking debt advice and therefore require the case to be out on hold for 30 days as per court pre-action protocol.
If you want this over with asap you could instead tell them to issue a claim at their earliest convenience.
The claim will come from the Northampton CCBC.
I doubt very much that you will be supplied with a copy of the alleged contract at this stage, but you will at least be able to show a judge that you tried to narrow the issue at the earliest opportunity but the claimant failed to do so.
You will get to see the contract at the witness statement/exhibits stage much later in the process.
Personally, I would send the 30 day hold instruction plus the page from the LBC containing Box I filled out.I married my cousin. I had to...I don't have a sister.

Thanks both. I will follow the NEWBIES thread on the LBC section, which also includes the 30 day request for a hold.
Found out from @Coupon-mad that VCS sending the LBC directly means they aren't using a solicitor. So sending a letter to the address listed on the LBC form asking for the hold.
@Fruitcake I will include the request for the contract (even though it'll likely be rejected) via the SAR.0 -
The contract is nothing to with a SAR and you will NOT get the contract2

I want to request the contract for the reason Fruitcake mentioned. I don't know who the land owner is. My work place rents the office, doesn't own the land. I haven't been able to make a complaint to the land owner yet, outlined in the NEWBIES thread. The contract might assist with that. Even if it is rejected, which I agree it will be, at least I can show that I've tried to resolve it via that route. Or do you think I should ask who the land owner is in my SAR?1 -
The SAR is a request for the data controller, the PPC, to provide you with copies of data they hold about you, and only you.
The SAR goes to the PPC, the 30 day hold goes to whoever sent the LBC.I married my cousin. I had to...I don't have a sister.

I'm a bit slow, but figured it out in the end :l:lol:
I will ask for the land owner rather than the contract and i'll send that to VCS (Not the SAR email).
Cheers all!0 -
No, ask for the contract with or flowing from the landowner that they intend to rely on should they issue a claim.I married my cousin. I had to...I don't have a sister.

State that you are asking for this evidence (the landowner contract) to narrow the issues, as required under the pre-action protocol.
Looks bad on VCS later, that they'll refuse.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you. I printed a letter to send but will redo with that line (pre action protocol). have a good evening.Coupon-mad said:State that you are asking for this evidence (the landowner contract) to narrow the issues, as required under the pre-action protocol.
