VCS Fluttering Ticket / Valid Permit - We won...

    *Update*

Today the IAS rejected my appeal. The crux of their argument was that even though the permit fell from the window (hours after it was applied), it's still my responsibility. Ignoring all the points I raised.

Expected after being informed by the community that they're a kangaroo company.
No surprise, the IAS is only a protection members club, a scam set up by the infamous Gladstones solicitors .... I assume throughout the time you have held the permit, this is the first ticket as a result of the permit falling off the dashboard/window ?

Had you abused the system before, you would have had many tickets. But you DID NOT.

You have proved you have a valid permit but sadly VCS IGNORED THIS showing their only interest is to collect money

If this does go to court, appeal to the Judge's logic especially that VCS know you have a permit

As you would have read on here, VCS are NOT the bee's knees when it comes to court, far from it

A prime case to ask a judge to dismiss the case and award you costs

    Good morning,

That's correct, this is the first time I've had a ticket.

I did explain during my dispute on the IAS portal with the parking company, that their argument implies ignorance of the terms & conditions. That's not the case here.

I've also been in contact with my local MP who did contact the IAS (the MP asked for the ref number), but sadly, that seems to have been a wasted effort. I did thank the MP regardless this morning, as I appreciate they must be busy.

I do plan on going to court if it comes to that, and I will update the community with my witness statement & defence.

    Thanks for your reply

    Hi community,

Just thought I'd provide an update. Nothing has moved 'legally' but I did just receive a 'Demand for Payment' letter from VCS. This is the first contact they've had since the IAS rejected my appeal. The fine amount now is £170! Just thought I'd update with the demand for payment amount, as it is eye watering. Ridiculous that these laws from 2019 still haven't came into effect.

Ridiculous - yes - but the public caused this delay.

It's not caused by the Government, who are spitting feathers over it.

People who paid parking firms, unintentionally funded two Judicial Reviews and blocked the new Code.  The PPCs threw money at it and stopped the whole thing but it is victims' money that they used.  They don't have any other money.

Given you know that the statutory Code is temporarily stalled, we sincerely hope that you are au fait with the need to respond to the final Government Public Consultation to join our push to get it over the line?

Hopefully - amongst all the political disruption - it will be open later this year and into January.  The DLUHC have said it will be a 12 week consultation this time, not four weeks like before.

If PPCs manage to turn around the decision on banning the gaslighting / claim-funding 'fees' then the DLUHC will be rubber-stamping £200 parking charges and if that happens, they (Government) and the PPCs will wreck high streets and people's lives.  Whoever is responsible, if that happens (and it very nearly did in 2021) must hang their heads in shame.

Just checking you are among those ready to respond to the questions as you have personal experience of how this crap of £170 eye-watering demands actually feels?

Please come back here when it opens, and you can make sure you don't miss the Consultation:

If you are not likely to be a regular reader in the coming weeks/into 2023, to be alerted you'll need to bookmark the thread by MSE_JC at the top of the forum and enable (on your profile) email alerts for bookmarked threads.

This will be your only chance to influence the law.

It's insane. Whats' worse, I was told by VCS that if I appeal to the IAS, my reduced offer would be removed. How that's legal, is a mystery.

I apologise for my ignorance, I wasn't aware of any of what you said, but I will bookmark the thread. Is that all I need to do? Then keep an eye out for notifications?

No, that is not worse, that's perfectly normal.  The discount is effectively a bribe not to appeal.  The PCN is always £100, it's not less than that, it's just that you can pay a lower sum if you just cough up and go away.

That's also how a Council Penalty Notice works.  This is the norm, forget it.  Nothing to see there.  Please don't go down blind alleys and miss the really really big picture and the main issues.  The MAIN ISSUE is banning the fake added £70 extortion.

As long as you read and bookmark the thread and understand the issues (by reading the summary I added to that thread) and as long as you have set your profile to allow email notifications for bookmarked threads, you will be alerted.

We will be talking about it when it opens and discussing the Impact Assessment the Govt will draft, and the questions in the Public Consultation and how we plan to answer those (although we want everyone to respond in your own words and we will not be providing a template set of answers - the work of the devil!).

Ok, got you, I'll ignore the discount offer. Thanks.

Although I agree the amount is unreasonable, and I welcome the proposed law change, it doesn't help my specific situation here. I will however do what I can to help.

My situation as you read several weeks ago is that I have a valid permit which fell from the window, and even though this was explained, I'm still being targeted.

Last question, if VCS do issue me with a CCJ summons, should I write my defence and share in a new thread? Is it bad practice for me to keep updating here?

    Thanks!

You can't get a CCJ nor a summons.

But if you get a COURT CLAIM FORM then please please please stay on this thread if you started it (I didn't check).  One thread per case please, not new ones.

Got it, thanks so much for all the guidance so far. I'll keep this thread updated with everything I get. Followed your advice and updated them with my new address (which is where this demand letter came to), but have had zero contact in any other regard.

Thanks again, you're more helpful than you realise. So many people (myself included) get overwhelmed with this entire process and the number of letters that are sent.

    Best regards,
