Update: I’ve now received a ‘Final Demand’ letter. Stating that they intend to take County Court Action.

Is it worth me starting my defence now, or should I actually wait for the court claim form?

Also, the letter they sent states the following “you have received this notice because the company intends to take you to court in relation to this debt.”

just to confirm, they can’t obtain a CCJ without me having the opportunity to defend myself, right?

According to the newbies thread, I should request a SAR. Should I start this now or only once the court claim form arrives?

edit: read this, apologies for mentioning debt collector drivel. The ‘final demand’ wording spooked me.

    Thanks

No need to let us know about any more letters unless you get a court claim

Hello, ive ignored another 2 letters since my last post, but I’ve received another letter and I can’t work out if this is the court claim letter I’m supposed to respond to, or if this is something I should ignore? Will hold off doing anything until I get confirmation from the experts.

    Thanks.

It looks like a letter before/of claim giving you 30 days to respond after which they will issue a claim.

It is up to you how you respond, but you are not required to fill out their forms.
You could fill in part of the forms, for example Box I only, requesting the contract with or flowing from the landowner that they intend to rely on in any claim.
Never give a 'phone number, ever.

You can if you want more time send a 30 day hold instruction. If you want to do this, then send it around day 25 from the date on the letter above.
State that whilst you deny the debt you are seeking debt advice and therefore require the case to be out on hold for 30 days as per court pre-action protocol.

If you want this over with asap you could instead tell them to issue a claim at their earliest convenience.

The claim will come from the Northampton CCBC.

Thank you. Requesting that contract might be useful for me, as I’m one of the ‘fluttering ticket’ cases. It could poke holes in what they’ve been asked to do by the land owner when I get my defence together.
