Is there an easy way to find the relevant threads? I presume there is using their user names, but I am just not sure how...

    Don't worry, found it.
  • On another note I have started to put together a witness statement based on the template linked in the newbies thread as follows: https://forums.moneysavingexpert.com/discussion/comment/77614685/#Comment_77614685

I am of course just following the structure and maintaining and relevant text, however there are a few things I would welcome expert opinion on.

    1. My defence is based largely on the lack of suitable UKPC signage. As well as providing photos of the signs in my case and comparing to the Beavis v ParkingEye signage, is it a good idea to include photos of what I consider to be acceptable signage from another site (a local Euro carparks site) that meets industry standards. The site has high level, illuminated signage all over the carpark and the signs and clear and precise. The UKPC signage in my case is none of those things, and drawing comparisons with photo's for each site really highlights just how poor the UKPC signage is. My only concern, is if it is just too much information that the judge may feel is confusing and irrelevant.

    2. The car-park in my case serves a public house. The Tripadvisor reviews for the public house are a wash with comments from angry customers who have suffered the same fate as myself. The comments refer to the situation as a "scam" and "entrapment" and also make reference to the lack of lighting and signage in the carpark. Is it worth including these reviews as a an exhibit as part of my witness statement to paint a general picture and demonstrate that I am clearly not alone in falling foul to the (lack of) signage.

Thanks for your thoughts in advance.
Any thoughts on this ? I would really appreciate any comments as I would like to produce the best WS possible.
    Thanks.

    1. Use the ParkingEye signs as your industry standard as it is what the Supreme Court in the Beavis case referred to as unusually clear signage.

    2. Use the tripadvisor comments to show this appears to be an entrapment site with inadequate signage deliberately used to enhance parking revenue rather than to manage parking.

UKPC signs are always pants, and have been for years, but have refused point blank to do anything about it.
Earlier this year the BPA held a seminar where they told all their members that whilst the new government CoP is not yet mandatory, PPCs should be adhering to its requirements with immediate effect. This included using adequate signage.

Do you also need to send a copy to DCB Legal in this case? Or just the courts and UKPC as the claimant?

    Thanks.

Send it to the claimant's solicitors. Also email it to yourself. Some PPCs have a habit of saying they never received something by email, but if the court received it and you received it, then on the balance of probabilities, the claimant received it as well.

    Will do - thank you.
  • Merlin2022 I am in exactly the same situation as you. I parked in The Red Lion Pub at Woburn Green in December 2019 and have now been given a trial date. The Claimant is UK Parking Control but the solicitor is QDR. I cannot believe they are taking this to court. Please could you contact me as I could really do with some advice.
