Hi all,
As my court dates approaches I have heard that UKPC are continuing to take these cases to trial, specifically for the site in question in my case.
I was wondering, how would I stand if UKPC were to win one of these cases prior to my court date.
Playing devils advocate, what if a case prior to mine had a much weaker and inferior defence prepared, that enabled the solicitor to sway the judge their way and award UKPC the win, thus setting a precedent for the site in question?
Any thoughts would be appreciated as always.0 -
County Court cases don't set precedents.
However, Judges are human, allegedly, so I guess it is possible for his/her thoughts in an earlier hopeless case to be 'carried over' to the next one.3 -

I have added a point to the above effect in my WS, suggesting the relationship with UKPC contributed to the demise of the pub.
Given that UKPC are locally based (head office a mile from the parking site) is it fair to include a further point in my WS that expands on the horrendous reputation of UKPC within the local community (which is entirely true; from their owner being captured parking in disabled parking bays in his Porsche, to the company being suspended from the DVLA for falsifying evidence etc). I would probably refrain from going into too many details, but would just be trying to paint a general picture of how UKPC are viewed to add credibility to the previous point regarding the closure of the pub.
I just don't want to end up adding something that the Judge may view as irrelevant and some sort of slander.2 -
Someone who I have been speaking to online who received a parking ticket from UKPC for this very site (Red Lion Car Park, Wooburn Green) had their day in court today.....
UKPC (represented by QDR Solicitors) lost the case (Northampton Court). The judge took them apart on the basis of their (lack of) signage apparently.
They person involved isn't a member of this forum, but just wanted to share the news.
Good to see UKPC in the mud again...8 -

We need genuine victims of PPC aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.

I have today received the email from DCB Legal that I have been waiting for:
"We act for the Claimant in the above matter.
Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s N279 Notice of Discontinuance for your records.The attached has also been filed with the Court.
We will now proceed to close our file accordingly."
I know of two cases already regarding the parking site where UKPC have lost, so I guess they didn't fancy another beat down.
What an absolute bunch of clowns both UKPC and DCB Legal are. An utter embarrassment.

Well done, sir. Now added to the UKPC/DCB Legal discontinuation thread of shame.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
