the particulars of the claim are entirely inadepute
neither the court or the defendant are able, on the basis of the particlars within the claim form to understend properly and specifically what case is being pursued
the particulars appear to be in breach of CPR 16.4, i6pd3 and 16pd7
I think they didnt fill in the forms in correctly1 -
Haha, it wasn't them filing in the forms wrong! That's saying that the way they pleaded the case (on the left of your claim form) is incoherent.worksvanparkingticket said:Hi all
I think I won?
it is HEREBY ORDERED THAT
1. the claim is struck out.
2. because the order has been made without a hearing ,the parties have the right to apply to have the order set aside, varied or stayed.
thansks again for all the help.worksvanparkingticket said:the particulars of the claim are entirely inadepute

As above but looking at the PD, it states7.5 Where a claim is based upon an agreement by conduct, the particulars of claim must specify the conduct relied on and state by whom, when and where the acts constituting the conduct were done.
- All land is owned. If you are not on yours, you are on someone else's
- When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
- "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
- All land is owned. If you are not on yours, you are on someone else's and their rules apply.

Just a heads up but I gleaned from a couple of DCBLegal claims I was reviewing, that it looks like they might not always put the date of event in the POC.
We should ask the next person with a DCBLegal claim exactly what the POC say.
I wonder if this was noticed by the Judge.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There is that wonderful Supreme Court case Barton v Wright Hassall LLP that can be used alongside the PD but it requires the OP's to publish a redacted pic of the particulars so they can be checked for these flaws. Should be at the earliest opportunity so they don't shoot themselves in the foot at the defense stage.
