County court Business center UK Parking Control
please help,
I have a letter from the County Court Business Centre dated 3rd August
Its with regards to parking on the 29/05/2017
I have logged in to moneycalim website and logged a AOS today the 15th Aug
what is my next step?
this way in a works van
1. the defendant is indebted to the claimant for a parking charge
parked in breach of terms
the pcn was issued on privateland
the driver agreed to pay within 28days but did not. D is liable as the driver keeper. despite requests, the PCN is outstanding c to damages
1 £160 being the total of PCN and damages
2 interest rate of 8%
they are after £319.52
what do I do next?

Follow the guide to court written by bargepole that you will find in the second post of the NEWBIES Announcement at the top of the main parking forum page.
Having completed the AoS you have 33 days from the issue date on the claim form to submit a defence. That's plenty of time, but do not miss the deadline.
Use the template defence sticky Announcement to create your defence. The same Announcement includes a twelve step guide to follow as well.
Amend paragraphs 2 and 3 of the template to suit your case and show them here for checking.
Submit the whole template including your amendments to the CCBC by email once the regulars have commented on your changes to the template.
Send an SAR to UKPC as per the advice in the NEWBIES.
You say the alleged event occurred in a works van. Are you the registered keeper or hirer/lessee of the van?
If you were not the driver of the van, or don't know who was driving the van on the alleged date, then say so in your defence. Do not volunteer any other information about who might have been driving.I married my cousin. I had to...I don't have a sister.

its a works van that was owned by a company I no longer work for. But i did but it later that year
I contested the fine when it came through but never had a reply as I have move house since.

An SAR is a Subject Access Request, and should be sent to the DPO of the claimant along with non-photo proof of ID.
If you sent an SAR to Moneyclaim.gov, you will have wasted your time as it will never have gone to UKPC.
Having moved house, you should instruct the DPO of UKPC to erase your old data, replace it with your new address for service, and instruct them to inform all their agents of the same. Again you will need to provide non-photo proof of ID.
It is essential that you use the word I have highlighted.
It is not a fine.
Ownership of the vehicle is irrelevant. That still doesn't tell us if you were the registered keeper or hirer/lessee of the vehicle at the time.
If you were not the registered keeper but were the vehicle's hirer lessee, then you may not be liable for the charge, but only if you didn't reveal the driver's identity when you appealed.I married my cousin. I had to...I don't have a sister.

Look at UKPC's website. It will (should) have details of how to contact their DPO on their Privacy or Contact Us page.
The response to the SAR will tell you what you put in the appeal, but I'm sure I couldn't remember who was driving a specific vehicle on an unremarkable day 5 years ago.
If it could have been someone else then you should say so if true.
If you know it wasn't you, you should say so if true. I would suggest this should be mentioned in your defence and let the claimant prove the contrary is true.I married my cousin. I had to...I don't have a sister.

ok I have also sent an SAR to the parking company as well . I'm not sure who was driving at the time or even where the car park is to be honest or which van it was.

You are being scammed by DCBL. The interest @ 8% is outdated, judges will kick this out of the scam as much as they will normally kick out the fake add-on of £60
Very difficult to prove damages .... maybe they mean that it stopped UKPC from issuing a ticket to someone else ..... UKPC are not entitled to damages nor are DCBL

You will find the response to the SAR useful at the witness statement/exhibits stage, but the earlier you receive it, the earlier you will know what you are up against.
You seem to be confusing the AoS (Acknowledgment of Service) which has to be completed using MCOL on the government website with an SAR (Subject Access Request) which you should send to the claimant in order to find out what personal data they hold about you.
As for how long you have to submit your defence, I answered that earlier.Fruitcake said:

Please explain more how you come to have received the claim. You still haven't explained if you were the registered keeper, or if you were the hirer/lessee, or if the vehicle was registered to someone else, or if someone else was the hirer/lessee.
