Hi
Please explain more how you come to have received the claim. You still haven't explained if you were the registered keeper, or if you were the hirer/lessee, or if the vehicle was registered to someone else, or if someone else was the hirer/lessee.
this was my works van and owned by a company I no longer work for.
the claim came through the post while i was on holiday. I'm not sure how they got my address as i moved house 2 1/2 years ago
i did buy the van from work the year after but have sold it since
thanks again for the help0 -
OK, so you've done the AOS.
So now please show us your paragraph 2 and 3 to add to the Template Defence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

With a Claim Issue Date of 3rd August, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 5th September 2022 to file your Defence.
That's nearly three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.1 -

I have a theory.
It looks like your former employee was the registered keeper and at some point they received a PCN, then decided to name you as driver/hirer/lessee but didn't tell you.
As I said earlier, if you don't know anything about the alleged event you need to include this in your defence, and the fact that you never received a NTD or NTH by post.
If the above is true, or likely to be true, your defence should explain in your own words that: -
The defendant has no knowledge of the alleged parking event, and never received a Notice to Driver (NTD) nor Notice to Hirer/Lessee (NTH), and is not aware of their employer ever receiving a Notice to Keeper (NTK) nor any suggestion from their former employer that they were ever liable for any parking charge.
The vehicle in question was owned, registered to, and operated by *company NNN Ltd*
It is admitted that the defendant was not the registered keeper of this company vehicle at the material time, does not know the identity of the driver on an unremarkable day X years ago, may have been the hirer/lessee, but liability is denied.
Explain that multiple employees had access to and use of the van, therefore on the balance of probabilities, the defendant was not the driver, and liability was never transferred to the defendant as driver or hirer/lessee.
You should be using words like, "It is denied that ..." and, "The claimant is put to strict proof that the contrary is true."

HI
I Have had back the SAR request
and they have copied in the appeal I did but to my knowledge I never received this.I would like to appeal against the parking charge you issued on Monday 29th Maythe van is a long wheel base VW transporter with a bike rack on the rear. I tried to fit in 3 different spaces butwould of caused an obstruction if I had parked in the bays as the rack would have stuck out in to the road. Iasked a UKPC employee in a hi-vis what I should do. They informed me to park where I did so not to causean obstruction. upon returning to the van I had been issued a ticket
where do i go from here
thanks again for the help

Do you mean they've sent your request back to you or do you mean that you have received your data as a result of the SAR? What is the rest of your post? Is it the basis of an appeal to the parking company or the start of a POPLA appeal or the basis of your defence? Reading back, I see you have been issued with a claim form so can take it as the basis for a defence. Find the defence template from the front page of the parking forum and add your defence in there as paragraphs 2 & 3 using the same style in which the template is written.worksvanparkingticket said:HI

If you were directed to park by someone you assumed was an agent/employee of the parking company you can use promissory estoppel in your defence.1 -
Well it's obviously perfect!worksvanparkingticket said:HI

You had permission from UKPC to park there!
What more do you need to know? It's easy!
As @Le_Kirk says:Find the defence template from the front page of the parking forum and add your defence in there as paragraphs 2 & 3 using the same style in which the template is written. If you were directed to park by someone you assumed was an agent/employee of the parking company you can use promissory estoppel in your defence. You can obviously search the forum for promissory estoppel defence to find a recent one with that wording already written.

By reading the NEWBIES thread you would've been directed towards the Template Defence thread.KeithP said:To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.

Others also pointed you towards the Template Defence thread.
Did you find the Template Defence thread?
I ask because the opening post on that thread describes exactly how you go about filing a Defence.1
