    It would be one of your lines of defence - a powerful argument, accepted by many judges, but no one can guarantee it as a silver bullet. Please read the Template Defence announcement to learn of the other lines of defence you will also need to use. 

    But let's cross the 'going to court' bridge if we get there.

    I can’t imagine they’ll just drop it before hand. They’ve been very persistent with the letters and threats.

    Your imagination needs a bit of honing.   :)

    All those threats and letters are sent to bully you into paying.
    Very often we see these cowboys realise their threats aren't working and give up.

    But of course there are no guarantees that will happen in your case.

    unfortunately well unfortunately they have persisted. I haven’t heard anything since the back end of last year but I’ve had a fresh letter through from a bailiffs company. What I can’t understand is last time the letter was from a solicitor threatening to take me to court and now we’ve gone back to the bailiffs. A different company from the last time they threatened woth bailiffs. Where can I find the template defence announcement please?

    You've already been told several times and it states so in the Newbies/FAQ thread, which you should have re-read several times, about "bailiff" letters. You IGNORE those letters as advised.

    Also, was "last time the letter was from a solicitor threatening to take me to court" actually an LoC or LBC? Probably not as if it was it would have to adhere to the PAP in section 3 of this document: https://www.justice.gov.uk/courts/procedure-rules/civil/pdf/protocols/debt-pap.pdf

    I am a little surprised that you are obviously prepared to pay a premium for your child's education but you do not appear to be putting in the required effort here to educate yourself on all the steps as explained in the Newbies/FAQ thread. It may appear daunting or even overwhelming but it is a required effort on your part in order to assist you in combating this scam that you now find yourself in.

    You have nothing else to do for now except continue with Plan A, which is to get the landowner or the school to get this cancelled. A timely reminder that they are equally liable for the actions of their agents would not go amiss.

    If/when you receive a REAL LoC, come back after having read the advice in the second post of the Newbies/FAQ thread on how to deal with it and what to expect and when. You'll know it's a real LoC because you have the information that is required in one of those in the linked PDF I have provided above. I even made it easy because I have already told you to read section 3 of that document.

    That is not even a proper letter before claim; it is a debt collector letter designed to frighten you into paying, as can be seen from only giving you 14 days to respond not 30 days as required.  They can only take "bailiff action" if you have been to court, lost and failed to pay what the judge said in the judgment.

    Just means that your data has been passed around again and it's likely that the eventual claim will come from DCB Legal - which is great news, as they pretty much always discontinue claims we defend!

    Which bit of that letter conforms to the PAP as described in section 3 of the document in the link I provided you?

    As @Le_Kirk has explained and as described in the Newbies/FAQ thread, what you have there is just a harmless debt collector letter. You really need to go back and STUDY the Newbies/FAQ thread and perhaps have a look at other threads on here to get a better perspective on where you are in this scam.

    If you don't understand it, you study it some more until you do. The same advice you probably give to your child.
