    Thank you all, and hello.

    I realised that the claimant has to pay that 27,  just worried that I'll end up liable to pay that and/or other fees too.

    @verdomde, you really need to go back and re-read the Newbies/FAQ thread, assuming you've already read it one. A skim-read is not satisfactory and you should keep referring back to that thread every time you have a question. You use the Newbies/FAQ thread as a reference.

    I got a letter back from the solicitor, it just syas they want the full £250-ish in one payment, just fyi.
    I appreciate the positive vibes, just don't want to end up more in the hole. I'll read as much as I can follow from the newbies thread and try to work out if I'd have to ultimately pay more on losing and what I can do to try and win.

    That suggests you wrote to the solicitor - why?  Just read some court reports (successful and losing) and you will see that even those (rare ones) that lose, do end up paying LESS than the claimant initially claims because most judges knock off the spurious debt admin fees.  If the claimant wins, they are allowed to claim filing and hearing fees but NOT legal costs.

    I had already written as it said we should try to negotiate outside of the court. I was told when i came on here I shouldn't, but I'd already emailed.
    I've not responded, though they have asked me to.
    Is the hearing fee the £27? How much is a filing fee (if you know)?

    How much do you think they have spent in chasing me for £250?

    What do you care? The more, the better. They are not allowed to recover that in a small claims court case. That is why it is a "small claim". Their legal costs are fixed at £50.

    The only time they could claim more is if you acted unreasonably and the court agreed. However, it is far more likely that the claimant has acted unreasonably but, again, you have to prove that.

    The claim form already tells you what they are claiming. Even if you were to lose, you wouldn't pay that amount as they have probably added the £60-£70 "contractual costs or damagers" which the judge should disallow as it is beyond what is allowed in a small claim.

    Which they can't claim, unless you act unreasonably such as not turn up to a hearing.

    Nor are they likely to get the added fake £60 or £70 nor 8% interest. That and the filing fee is already in the £250.

    So even if you lost, you'd pay less than that.  You are at no risk as long as you've done all that the court has asked, and turn up.

    They will probably discontinue.

    Have you already been paid your £275 costs?
