  • Hi all,  I have read the posts and the whole process is really stressful and taking its toll on me. The fact that I wrongfully parked in a disabled bay would suggest I am already in the wrong - And I cant see any point in dragging this along.  If I were to send the form back with happy to mediate (id just have to pay the cost in a credit card!) - Would they then reply with amount I need to pay in full? Thank you.

    No. Don't do that.  NOT MEDIATION. It is a form of bullying of Defendants by phone.

    And you simply don't need to fold this early.

    If this is DCBLegal and UKPC, we are seeing almost every case discontinued. Including one this month involving a disabled bay.  There seems to be no rational sense or checking of claim details and they just hoover up money from people who pay and victims who get CCJs, and they discontinue the hard cases who don't pay (regardless of the facts) when they see a forum-assisted witness statement.

    You've surely seen @Umkomaas' thread last week gathering examples because the pattern is so clear? This will likely happen in your case too and you will pay nothing.  The MO is a phone call or email later in this process, from DCBLegal junior staff wanting to talk to you about settlement.

    You say NO. Hours later they discontinue.

    This is bulk litigation. A machine.

    There seems pretty much zero intention of paying legal reps to attend hearings.  They are clearly playing a numbers game.  

    Carry on as normal and if they don't discontinue after WS stage you can pay them anytime before the hearing if you feel your defence is weak, which it appears to be, as I said on page one. But I was never telling you to pay!

    Continue to poker face them.

  • Hello Coupon-mad. I haven't seen Umkomaas' thread. I will check it out. Thank you. 

    I find the whole process really stressful, and no leg to stand on in court & feel i will end up with a CCJ & a larger cost to pay for wasting time... Claimant is UK Parking Control Ltd.  I appreciate the encouragement and handwork of the group but as I've never dealt with this before, I am just not very confident at all. 

    I have a few questions if someone can please help with; 

    1. The CCBC has tones of Information about mediation and some information about hearing. I need to put in which court I prefer (I don't to want to go, but I am south east, so would prefer something around London if i had no other options). Can I add this?

    2. It further asks for witness statement - I am the witness as the driver. Do I add my details, as I have no other witness. Do I then write my witness (similar to the defence?). 

    2. I need to complete form N180 and then send it by 15th Aug. Do I post to court or can I scan / email? It also says serve to all other parties. Does this mean UKPC? I'd rather not waste money. 

    3. On the CCBC it states "1. This is now a defended claim. The Defendant has filed a defence, a copy of which is enclosed". I didnt receive anything else - assuming they are referring to my defence letter I had sent.

    1. You choose the court, normally the one closest to you. Many hearings now are being held via video link or by telephone. 

    2. A Witness Statement is a part of the process which must be completed, don't fail to do that otherwise costs will rise. Here are some examples of good WSs. 


    2. (your second!) You must complete the N180 and return it by the date required by the court. You can do it manually and post it (not recommended), or download a copy from the internet, complete it and email it back to the CCBC. You also forward a copy to the representing solicitors (not UKPC if they've instructed a solicitor - DCB Legal??). 

    3. That's a communication from the CCBC to the Claimant, you've just been copied in for information. Yes, it related to the Defence you have submitted.

    But all of this is clearly shown in the NEWBIES FAQ Announcement, second post, in the section headed 'IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!' and the 12 steps in the Template Defence Announcement, first post. As I've a few spare minutes, I've helped you out by providing the information that is already on the forum for you to read. Please read the available resource, it's there to relieve the pressure on regulars having to answer the same questions every day. The forum would collapse if we had to do this continually.

    You can, and sometimes we hear about SAR responses being returned in a day or two.
    But the SAR recipient does have a whole calendar month to respond and most appear to take that full month.
