    If this is settled before it goes to court, there shouldn't be an LPC Law agent fee anyway.

    LPC Law (company) = the local "goon for hire" (solicitor) who attends a court hearing on behalf of the claimant. This cost (~£150 - £200) is not recoverable as costs, unless the judge finds that the Defendant's conduct has been unreasonable ... the £50 legal rep costs in their claim is all they're allowed to claim.

  • Hi all, I've had a response from QDR and have until tomorrow to decide. Please let me know if £200 is reasonable. My offer was £183.  Thank you. 

    "Our Client is mindful of the obligations on parties under the Civil Procedure Rules to resolve their disputes where possible to avoid further cost and Court time. Our Client therefore is prepared to reach a commercial settlement with you. For the avoidance of doubt your offer of £183.00 is rejected. However, our Client is prepared to reduce the balance to £200.00. Please confirm by 4PM on 25 August 2023 if you are in agreement with this offer, please find attached details for you to make payment and please quote the reference xxxxx with any remittance"

    I think you have no choice because you are at risk of adverse costs (the rep's £200-odd attendance fee) and their rep will go for the jugular in court, if this continues to a hearing.

    Your mistake - apart from the parking - was not submitting a WS bundle in time (then not attending).

    The fact your WS bundle is indisputably very late means you can EASILY be painted as 'wholly unreasonable' by a slick legal rep, especially given the facts of the case which will likely see the Judge against you (the absent defendant) from the outset.

    Pay the £200. Walk away. Enjoy the new baby.

    Please please add photos as seen there!  Think of this call for evidence when strolling around your town and you spot car parks at churches, shops & businesses that are unrestricted yet there is no abuse, no 'carmageddon'!

    OR supermarkets with £70 PCNs only.

    OR hospitals with £50 or £60 to deter abuse.

    All I need is photos and location.

    I will do the rest... just post photos for me...

    I can PROMISE this evidence will be seen by the decision-makers because I'm on the Code of Practice Government Steering Group representing motorists, and the DLUHC will read my submissions.

  • Ive now paid the £200. Massive relief!

    Thank you @Coupon-mad and everyone who've supported on this thread. If it wasn't for you, I'd have paid whatever they asked !  I truly appreciated and won't be parking in a disabled bay again! Lesson learnt. 

    I agree @Coupon-mad - WS was late + defence was weak. However I hope they wouldn't have viewed absence as non compliant. I have no choice and currently on paternity leave and would never leave a heavily pregnant partner alone for 10+ hours  1 day before giving birth. 

    Will definitely look at link and support if I can. Thanks all for your help 🙏 
  • This is weird but do emails sent to county court get auto deleted from sent item folder? [Im not going mad i promise] I've sent 3 emails to the County Court and can't seem to find any of them other than their auto response. ?!

    No I've never seen that. But don't worry, just email QDR now confirming that you paid £200 and that you quoted their ref.

    They will tell the court that the case is settled.

    I think £200 is pragmatic at a stage after they paid the hearing fee and they were after this amount:

    Amount claimed: £182
    Court fee:  £35. 
    Legal rep costs: £50. 
    Hearing fee:  £27
    Total - £294

    Basically you didn't pay the fake £82 fee and you got a further £12 off as well. The PPC made £100 (or probably less, depending on how the agreement with QDR shares the money).

    Infinitely better than risking a hearing being lost and an extra £200 layered on top of the £294 as 'punishment' for the very late WS, which wouldn't have taken much pushing by a legal rep who would have 'had the floor' to themselves, to paint you as some sort of rogue.

    You were not going to win this one and could have been stung for £500.  This is better than the position you were in when you first came here in 2022 with a claim already received.

    No rush with the photos. But do think if it!

    We have September to collect these pics. Maybe you'll spot that the PCN at your maternity unit is £50 or £60 and can get a nice photo while you are getting fresh air in the car park on the big day!
