    Answering your questions:

    1. this is already in the template defence.

    2. that argument about location, including the website defining the museum car park as the small area, does have legs.



    So more abuse of process as I'm supposed to have until next week to respond to LBC after requesting 30 day extension. So they've ignored PAP. Oh well, more to add to my official defence & complaint to SRA. If I get a claim form or post date is before revised deadline (showing they didn't grant extra 30 days), is it still valid? 

    Re 2. As in legs for me? So location isn't merely a descriptor, only contract in relation to the specific land named under location is relevant? (Sorry if already answered in Forum, I have tried to find but to no avail)

    I wouldn't put too much time and effort into that.
    I can't see a court being too interested in a few days discrepancy.

    Responding to a LBC deadline is not as absolutely critical as, say, Defence and Witness Statement deadlines.  Nonetheless, there's still a week available, but a LBC response doesn't need to be detailed - a short note to say you deny any debt exists, or is owed to their client. Should they issue court proceedings you will, with expert assistance, robustly defend the claim. That's about it - put up, shut up or bring it on stylee. 

    Hi I'm a little confused. I simply requested 30 day extension for debt advice in my initial LBC response email to solicitor (thought that was sufficient at time). Didn't list all the evidence client needs to provide. Now that I'm officially responding (after 30 day extension) can I still request the above or have I missed the boat? Did I need to have done that within original 30 day deadline?

    I can't find above thread (& there are no links on Newbies section). I've searched under LBC responses though & have come up with the following: 

    I am writing to advise that I have referred this matter to my MP who has contacted the landowner on my behalf. The landowner has requested a reasonable amount of time to investigate & respond. I therefore request that you & the claimant place the case on further hold until the landowner responds, to avoid further costs.

    I must advise having reviewed photographic & video footage of the site in 2018 that I deny the debt. I have sufficient proof that no contract existed between the driver & your client. I suggest therefore that your claimant discontinue the claim now. 

    Should your client choose to pursue a claim I will rigorously defend with expert advice. I will also require (list of evidence required from claimant) plus robust reminder re PAP requirements & unable to defend without.

    If you continue to include illegal add ons & uncapped solicitor costs above £50 to the claim this will be challenged in my defence & I will report you to SRA.

    Just FYI, the Newbies section on LBC stage advises a basic response to LBC, not robust response & no example. It also doesn't advise to wait until end of initial deadline to send that LBC response  This might be worth updating to avoid numerous LBC response queries.....
