Items not received - £800+ lost?

Hi,

I bought 2 PS3 consoles of a seller as I was running out of stock and needed to get some more. His auction said allow 7 days for delivery which I've done. Since then he has got a lot of negative feedback. From his feedback, it looks like he refunded his other buyers but not me. I have sent him numerous e-mails over the past few days but no reply. I told him I'm going to report him to the police. Still no reply. It's been 11 days. The auction said there's paypal buyer protection for £500. Does that mean I'll only get it, if they can get it off him? I'm really worried. This is going to ruin my whole christmas if I don't get refunded. Please help me if you can . Here's the auction:

He has a business account. Surely he can't do this to me. His auction says "scammers leave me alone". Looks like he's the only scammer :mad:

    Please tell us you funded with a credit card?!
    A business account means nothing, you don't even have to link it to a business bank account , which is ludicrous.
    Have you started a dispute in Paypal for items not received?

  • Wow. Thanks for the replies. Yeh I already opened a dispute 2 days ago and the status is "awaiting seller's response". I didn't fund with credit card. Came out my bank account. I trusted this guy. He didn't have those negs and neutral when I bought from him. I must have been really foolish :(
  • I had a similar problem with an ipod.

    Open a paypal dispute straight away and escalate it to a claim immediately. Exlpain what has happened and why you are worried/suspicious (make sure to mention the other negative feedback). The seller then has a certain amount of time to reply. If he doesn't reply or can't explain himself paypal are very likely to decide in your favor and then refund the money up to the limit of the specified protection (so £500).

    If you paid with a credit card you are in luck. Phone the company and explain what is going on. They will have to wait until the paypal investigation is over but then you can claim the money from them. It is called a chargeback and can be made upto six months after the purchase. Keep all emails etc that show you have tried to contact the seller and resolve the dispute yourself. With chargebacks they have to wait until 30 days after the purchase before they can do anything but after that is very quick.

    I initiated a disput and paypal refunded £150. The credit company then refunded the remaining £25 which was not covered by paypal.

  • Thanks for the great advice. I don't see paypal deciding in his favour but this may be naive as you never know with paypal! I escalated the dispute into a claim immediately as you suggested. He has until the 23rd to respond I think. As mentioned I stupidly didn't pay with a credit card :( Can you just clarify, will paypal refund me even if they can't get fund off the seller and do you think they would refund the full amount i.e. £500 protect per item? What seems really strange to me is that he's refunded other people. He must just have something against me :(

    I would say they were selling items they didn't own. ie Sell the item then go out and buy it and post to seller.

  • As far as I can tell, paypal will give you the money even if he doesn't do anything. That is what happened with me. As for the money, I suspect it may be £500 per transaction not per item. You probably need to read the paypal blurb very carefully. If it is per item, I would expect you to get all your money back.

    In future, always make any purchases off the web using a credit card. That way, if goods don't turn up you are always covered by law from goods not being delivered. Unfortunately, sing a debit card is just like using cash, you have no protection.
