Yep we can help at WS stage.

The DQ N180 form (and how to film it in) is already in the NEWBIES thread 2nd post, under the red heading IMPORTANT: KNOW WHAT HAPPENS WHEN.
    very helpful thank you
Hello - hopefully a quick question - I've read the newbies thread and I'm a bit confused - I haven't received anything from the court yet (just solicitors saying in due course I will do) so should I wait for this before sending the directions questionnaire or fill out from gov site and send anyhow? or just fill out so it is ready when I'm directed to send? Thank you
How long ago did you receive the solicitors' letter (above)?

Check your MCOL history to see if your DQ is on its way to you.
I've checked - history last response listed is the AoS?

Received email from solicitor 12 sept - nothing in post

Does it not also show your defence as being received?  Seems weird that you are talking DQ and the status page doesn't acknowledge your defence nor does it state that DQ sent to claimant!

Hi there, I wonder if you can advise -  received confirmation by post that my defence was received
    Who sent you that letter?
Received email from solicitor 12 sept - nothing in post
    What exactly did that say?

Hi - I thought that odd but defence definitely received  - had email and letter confirming from HM courts and tribunal service.

    from dcblegal:

Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim.

In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.

If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.

That should be showing on your MCOL history. But as their communication is just a template which we have seen dozens of times, I wouldn't hold great faith in their 'confirmation'!

If you're consumed by wanting to know whether or not to complete a premature DQ, you could, if you're prepared to be 'on hold' for up to an hour, give the CCBC a call to check on DCB Legal's 'confirmation'.  However, you might want to re-read bullet point 7 in the advice given in the Template Defence Announcement's opening post ....
    7. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.

Thank you, will do, doesn't sound like I'm behind on things then which is what I wanted to check. Thanks

Post from the court today with questionnaire.
  • Hi - quick question - I have done everything in my replies under my married name (i sent them marriage certificate etc to correct) but the directions questionnaire is in my maiden name, when filling out shall i continue to put in my name as it is now?
  • also - following the info in the newbies post - d1 on my form asks about suitability for determination without a hearing. I can't see anything for a response to that as in the guide it says to list court name here. Thank you

Find a post by @Grizebeck and you will see that it is a new form and question and the answer is you do not want a case heard "on papers" as you will lose!
