parking fine from 2016 - advice please

49 Posts

Hello, I am trying to sort a parking fine from 2016. I have requested a SAR and sent my V5c but the fine is in my maiden name, previous address and previous car. Don't think I have car docs on maiden name. What's the best way to approach please? They sent a form to fill out but I know generally to steer away from this? Thank you

Now, have you had a Letter of Claim or something else? Are you aware of the details of the PCN, as the more we know, the more the help can be focused. If the paperwork so far is previous name/ address , how did it get to you ?
You certainly need to address both of those points ( name, address) so as to get the SAR and avoid a stealth CCJ.
When responding, assuming it's a Letter of Claim from a solicitor (not an actual court claim yet) just attach a copy of your marriage cert and proof of living at your new address (utility bill maybe) and tell the aggressive thugs to erase your old address.

Who is the PPC and the so called legal involved? WE KNOW ALREADY but just confirm
The scam is adding a fake amount .. £60/£70 to the claim
You do not complete the forms, you simply cannot give scammers personal info
1: You request a further 30 days as you are taking debt advice and deny any debt
2: You ask for their LEGAL authority to add the fake amount ... they have none ?
3: Ensure they correct the data they hold on you regarding a previous name and address
If they are stupid enough to proceed to court claim with a fake amount, then come back here.
Make sure to use the word I have highlighted.
I'm unsure what to do at this stage - I have received the following this week:
Do I contest it? The car was parked in a free car park - they state longer that the allowed time.
reply or try land owner?
Thank you......
Thank you for your prompt reply.

What is the name of the PPC please?
If you want/need more time then you can send the solicitors a holding instruction to the effect that although you deny the debt, you are seeking debt advice and therefore require the claim to be put on hold for 30 days as per pre-action protocol.
Send it around day 25 from the date on the letter of claim you mentioned above. That will give you about 7 - 8 weeks to try to get a cancellation and/or prepare for a court claim.
Read the guide to court written by bargepole that you find in the second post of the sticky Announcement NEWBIES. This is a step by step guide that will take your from the LBC right through to the court hearing.
Did you get a response to your SAR? Did it include a copy of the NTK? If so, was the NTK PoFA compliant? I am quite sure you cannot remember who was driving on an unremarkable day in November 2016. If you were not driving, or cannot remember who was driving, then the keeper cannot be held liable for the charge if the NTK was not PoFA compliant.
Do not under any circumstance reveal the driver's identity; not on here, not in your complaints, and not in any communications with the PPC.
