Parking Charge Notice ***** SUCCESS *****

I received a Parking Charge Notice dated 8th March 2022 in the post yesterday issued by Defence Systems Ltd T/A Park Watch. The notice states the payment of £100 is now overdue however this is the first thing I’ve received. It refers to a PCN affixed to my vehicle on 5th February 2022 issued for the reason “Parking in No Parking Area” at a supermarket car park. I have no idea what this relates to and I have definitely not had a ticket left on my car. There is no photograph on the PCN. I’m at a loss as what to do, can anyone help? Thank you.

    Hi Coupon-mad, I’ve read the Newbies thread but I’m still not sure how to proceed 🤦‍♀️. I’ve attached a pic of the Notice which is the first thing I’ve received despite it referring to a PCN issued on 5th February being affixed to the vehicle which it most definitely wasn’t. So sorry to be so utterly clueless.

    If you have not previously received anything by post, check that your V5C is up-to-date with the correct current address.  It is not unknown for tickets affixed to vehicles to "mysteriously disappear" and this is known as ghost ticketing.  Submit a SAR to the PPC (details in the NEWBIE) and also send a "whilst I dent any debt, I am seeking debt advice and require you to put this on hold for a minimum of 30 days" letter.  Details again in the NEWBIE.  This should give you a chance to check the V5C, receive any NTD from the PPC and prepare yourself for later if this turns to a letter before claim and a real claim form from CCBC.

    Yes, my V5C is up to date. So this Notice I’ve received is not a NTK? I’m so confused. I’m not even sure where I’m supposed to have parked incorrectly as there is no photograph and I didn’t receive a windscreen ticket on the day of the alleged offence. Also, don’t they usually send a reduced invoice at the outset? I guess that would have been on the non-existent windscreen ticket. I’m elderly and this is so stressful. I feel like just giving in and paying up and then I think why should I when I don’t know anything about this supposed offence.

    Exactly. Why should you ? I understand the feeling of stress, but remember that you do NOT actually owe anything at all unless this goes to Court AND a Judge agrees that you do. In the meantime, you/we can see what the SAR reveals and plan and fight accordingly. You won't get anywhere near court for months, if ever
    The pen is mightier than the sword ..... and I have many pens.

    Painting by numbers it is not.  Read it several times until things fall into place.  All/nearly all the information you need is there.
    You never know how far you can go until you go too far.

    Is the location of the alleged event somewhere that your vehicle might have visited, and near enough for you to go and make a complaint to the manager/CEO/retail site management company?

    Did what you said Fruitcake and yes there are photos. I’m parked on a white hatched area and this has jogged my memory. I’d been shopping in Tesco and on going to leave the car park I remembered I needed to get some cash out of the ATM. I pulled up opposite the machine and briefly left my vehicle on the hatched lines. I was parked there for 2 minutes max and there was definitely no ticket affixed to my windscreen in that time. That being said, I’ve obviously parked somewhere I shouldn’t and there is also a photo of a sign that looks huge! It states that there is a £100 parking charge reducing to £60 if paid within 14 days. Obviously that was impossible for me to do as I’ve only just received the PCN over a month after the offence. If I had been given a windscreen ticket as stated in the PCN, I probably would have paid it immediately. Now I’m angry because they have blatantly lied by claiming one was issued.

    It is not an offence.

    Send an SAR as already advised. That should flush out the NTD that was allegedly place on the windscreen, and "should" also show photos of the NTD in situe on the windscreen. It "should" also state the reason why the charge was issued. 
    You should include proof of ID such as a copy of the V5C.

    You should also take photos of the site and signage including the location where the vehicle was stopped. The google streetview images of the signs are too blurry to see what the Ts and Cs are on the signs.

    You should also appeal the NTK as keeper using the appeal template in blue you will find in the sticky Announcement for NEWBIES.
