You don't pay UKPC anything as they are nothing more than bottom-dwelling scammers of the first order. They have not incurred any costs "to process the enforcement". You should also advise the landowner that an ex-clamper thug cannot issue a "fine" and calling it that elevates the scumbags to a status they are undeserving of and could never achieve.

As with all these UKPC/DCB Legal claims, they will eventually discontinue if you've used the robust Defence as advised on this forum.
Exactly. I will send another email, but I don't think it's going to get anywhere if I'm being honest. If it goes to court, at least it will show that they're being unreasonable. I am being scammed and I have given them chances to rectify their mistakes.

If the landowner is calling this charge a fine, then they have absolutely no idea what they are talking about.
I don't think they're aware of a lot of things, they thought a charge can't be cancelled as it was too old. Not like they're the landowner in charge of their land or anything...

    Update from the landowner:

    "Hi [    ]

I have discussed your case again with UKPC and have managed to get them to reduce the fine to £60.

They are not prepared to cancel the fine completely as you have allowed the PCN to escalate to debt recovery stage. As a result UKPC have incurred costs to process the enforcement.

    Kind regards"

And whose fault was that in incurring costs? Good grief. Must I repeat myself??

What a load of old rubbish. UKPC Gargling sewage water again.

In the parking industry, debt collectors offer a "no win no fee" .... you did not pay them, hence they did not win, hence no fee to UKPC

UKPC told the landlord a blatant lie ..... how does the landlord feel about this ... his agent telling lies ????

A court judge would be right to hold UKPC or their daft legal in contempt for this PLUS a complete waste of the courts time

Your landlord should be asking for proof UKPC paid the debt collector and if UKPC have an invoice, they can forward it by return and not try to obtain a fake invoice

Best thing for UKPC is to fully cancel before they get in to a tangled web of DECIEPT.
I do plan to write another email back. I will mention this to them as well. I've been telling the landowner what is right and what is not, they're clearly just following UKPC's lies anyway. Goodness knows why.

Defence is sorted. Before I send it over, can I confirm that I need to send it to CCBCAQ@Justice.gov.uk?

    My response to the landowner:

    Dear [    ],

I am not liable to pay for the charge- not the “fine”- for the reasons that I outlined in one of my earlier emails. Therefore I do not understand why I should pay even £60 to UKPC. I will not pay even a penny to their scam.

I did not "allow" the PCN to escalate to debt recovery stage, as I was not going to answer to aggressive and thug like debt collectors, especially without being given the proper opportunity to appeal. It is very interesting that UKPC are using this excuse, as in the parking industry, debt collectors offer a "no win no fee”. I did not submit to the debt collectors aggressive threats by paying, therefore, they did not win, and there would have been no fee to UKPC.

UKPC are lying to you and I am sure that like myself, you are not happy about their deceit.

If they are so sure that costs have been incurred then I would like to see proof that the UKPC paid the debt collectors and if they have an invoice, they can forward it by return and not try to obtain a fake invoice.

Otherwise, I demand the PCN to be fully cancelled.

    Yours sincerely,

How can I improve this? I feel like I'm missing something. Any feedback would be appreciated.

You send it where the Template Defence says, then follow all the 12 steps set out there, re the next letter too, so you don't need to ask us (please...or we drown in repeated questions).

Your landowner complaint looks fine but won't have any effect.

You haven't explained the the charge is not a fine nor a penalty because an unregulated private parking company do not have the power to issue these.

MPs across all parties have referred to the parking industry as rogues, scammers, and bloodsuckers, and that the BPA is about as much use as a multi-storey car park in the Gobi Desert.

The fake add on admin or debt collectors charges are to be banned by the government when the new mandatory parking code of practice is introduced because our MPs know that it is a scam, and that the parking companies do not pay this charge to powerless debt collectors.

If you are using the template defence you will have seen this in that thread: -
    4. Send your signed & dated pdf as an email attachment to CCBCAQ@Justice.gov.uk but due to the CCBC's dysfunctional systems, only do this during working hours (a weekday) and you MUST get an acknowledgement straight back or it is NOT submitted.

@Coupon-mad and @Le_Kirk I was just not too sure, as I was expecting an immediate acknowledgement, which I have not received from them. I wonder if it’s worth sending again tomorrow.
