It isn't ambiguous, it is wrong though, and yes BG are liable for the damage caused by the incorrect information.3 -
Just to update, I went to the ombudsman who have now awarded - they didn't agree I should be placed back on the original guaranteed tariff but did award £150 compo. Financially, this amounts to the same thing for me, so I accepted this.0

Don't think I've seen anyone else get more than £100 even via the E.O. Well done !!
Does beg the question tho', why has the E.O awarded different customers different amounts as they were all basically making the same complaint!!0 -
Hi, I too have recently had an adjudication from the Energy Ombudsman. The E. O rejected my request to be placed on the original contract till 31.7.22. E. O ruled that the contract clearly states tariff is variable and small print explains prices can rise with 30 days notice. I responded with stating that it also clearly states Price is guaranteed till 31.7.22 so there are conflicting terms which you have chosen to ignore in the judgement. EO was not budging and said I could appeal.
The £75 goodwill payment offered by British Gas originally remained due to poor service.
Having read the Unfair Terms and Conditions Act it states that if there are 2 conflicting terms then the term most favourable to the consumer should apply.
So for advice, should I appeal stating the Unfair Terms Act, does the EO have the remit to consider the Unfair Terms Act. Not sure whether to fight on or not.
Sorry for the long post.0 -
