    Where do I get to see the claimants WS? The deadline on the form says 13th July 2022. 

    I know the name of the judge as its on the letter but blanked his name out when I scanned the letter yesterday on the forum, redacted info.

    The claimant's order from the court will state, as does yours, that they must file and serve, meaning they have to send a copy of their WS to the court AND to you.

    Thanks Le Kirk, they have not sent anything yet. I will email the court and ask them where is my copy of the WS from the Claimant.

    Why? There's no point. They have the same deadline as you, we expect. If you are not yet late then they are not late, either.

    Of course you wait till the last day possible but you need to prepare most of it now.

    You'll see it on 13th July 2022 - the deadline date. 

    Very few PPC WS are submitted before the deadline date.  There is no entitlement for you to see it before that date. Make sure you don't miss your deadline, it's the same date.

    Yes I see what you mean now, they are so cunning, My deadline on the letter says 13th July but I hope to get it complete by the end of this week with the help of all the great people on this thread. Thanks once again.

    I have received 2 emails from DCBLegal Today.


    One email is for another case from 2019, the claimant is UK Parking Control, The same claimant as the case on this thread:


    We write further to the above matter.

     

    When parking on private land, the contractual terms of the site are set out on the signs, copies attached. You are entering a contract and agreeing to the terms by parking and staying on the site. Parking in breach of the terms as stipulated on the signage means that you are then breaking the terms of the contract.  

      

    The terms and conditions on the signs stated that parking was permitted for vehicles clearly displaying a valid permit, or otherwise a parking charge notice would be issued. A valid permit was not on display, as is demonstrated in the photographic evidence attached, therefore the PCNs were issued and affixed to your vehicle. Copies of the PCNs are attached.

     

    Our Client applied to the DVLA for the details of the Registered Keeper of the Vehicle. Your name and address were provided. . Notices to Keeper were issued to you on BLANK DATES 2019 and BLANK DATES 2019, copies attachedYou were afforded the opportunity to; appeal the parking charge, transfer liability to the driver (if it was not you) or make payment. Neither a successful appeal, nor an adequate nomination were received, yet payment remains outstanding. 

     

    Reminder Notices were issued to you on BLANK DATES 2019 and BLANK DATES 2019, copies attached. This notice reiterated that payment was outstanding and confirmed that legal action may be taken and additional costs incurred if the parking charge was not paid.

     

    Our Client therefore correctly issued correspondence to you at that address. Despite numerous letters, payment remains outstanding.

     

    Having not received payment, address verification was carried out prior to the Letter of Claim being sent. The same address was located and as such the Letter of Claim was issued to you at the that address.

     

    You have 30 days from the date of this email to pay the outstanding balance of £340.00.

     

    Payment can be made via bank transfer to our designated client account:- 



    After the above email I receive this (below) from DCBLegal regarding the case on this thread.





    WITHOUT PREJUDICE SAVE AS TO COSTS

     

    We write to you in relation to the above matter.

     

    To assist the Court in achieving its overriding objective, our Client may be prepared to settle this case. I can confirm our Client would be agreeable to £240.00 in full and final settlement of this Claim. The current outstanding balance is £296.28.

       

    Should you be agreeable to this offer, please confirm the same within 7 daysPayment can be made via our website www.dcblegal by calling our office on via bank transfer: 

       

    DCB Legal Ltd Client Account  

     

    When making payment please ensure you include the following reference number, to enable us to allocate it to the correct case.

       

    Upon receipt of the settlement sum of £240.00 we will update the Court that the matter has been settled. If you are not agreeable, we will continue to follow the Court process as normal.

    So now DCBLegal said they will drop court proceedings for this case (this thread) if I pay them £240. 


    Rather than the claimant Uk Parking Control Limited and DCBLegal making this 1 single claim they are pushing the case individually which is in breach of 'Cause of Action Estoppel pursing the same claim twice.
