  • So from reading Bargoples thread I have to post off the N180 form and 1 copy to the claimant, then the court will write back to me confirming a date and deadline to submit my WS and date and time of court appearance . So I do not select which court I choose? At this stage I post off my N180 form and wait for the reply? Thank you everyone for helping me on this.

    5. The case file will then be transferred to your local County Court, and you will eventually receive a Notice of Allocation, giving you a date and time for the hearing. It will also specify a deadline for you to submit a Witness Statement, and any other documents you intend to rely on, usually 14 days before the hearing but sometimes earlier than that. Your Witness Statement can expand upon the points made in your original Defence, and must start with the following "I, Joe Bloggs, of 23 Acacia Avenue, Anytown, AN1 2BC, am the Defendant in this matter, and will say as follows". You should attach to your Witness Statement any evidence to support your assertions, eg photos of signage, etc. Optionally, you may also want to include a Skeleton Argument to flesh out the legal points, or you could include those as part of your Witness Statement.
If someone could clarify what I wrote in the above paragraph is correct?

I'm unclear what you are asking but of course you nominate your home court on the N180.

Hi Coupon-mad, so happy to hear from you, hope you are well.

Yes I will nominate my home court in my city on the N180.

Basically I was just askng is this process/steps correct:

    1. I post the N180 form to Northampton and a copy to the claimant
    2. Wait for the court to write back to me with a set date/time for my hearing
    3. Once I receive a letter of my date of court appearance I will also be notified of a deadline to submit my WS.

    Are the above steps correct?

In the mean time it makes sense for me to start working on my WS.

I have never dealt with the court before, I only seen it on tv

    Thank you Coupon-mad.

Yes, except email not post is best, as long as you do it in working hours and look out to make sure you get an acknowledgement from the CCBC.

    Hi Coupon-mad,

Yes I agree email is better as it keeps a record of proof.

I will scan the N180 form that I received in the post, it had markings already i.e. "defendant" was circled, it had a stamp reference at the top and my personal details were already populated so will use this form and hand write on it, scan it then email it to CCBC and email a copy to the claimant UK Parking control Limited.

Thank you once again for the advice.

I haven't read back to check, but from whom did you receive the N180, the court or the claimant/solicitor?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You don't email a copy to UKPC.  They are using DCBLegal.

Hi Umkomaas, thank you for your reply, good question, I checked by emailing CCBC Northampton to see if they sent me the questionnaire N180 or was it the claimant and they CCBC replied yes they did, the claimant at the last minute responded in time.

Hi Coupon-mad, thank you for your reply, on the letter I received titled:

Notice of proposed allocation to the small claims track in the box on the top right hand it is populated with the info:

    Claim number:
Claimant (including ref) UK Parking control Limited (with reference number)
    Defendant: My name
    Date:

As you said they are using DCBLLegal I will email them a copy.

    Thank you Coupon-mad.

Just to be certain, you do not fill out an N180 if it is sent to you by the claimant because they will part fill it in with details that are detrimental to your case.

Only fill out the form if it came from the CCBC, or download one, fill it in, then add your signature (print, sign, scan, return)
