  • Hi Guys re-posting my last post as seems to have got lost with the response from another user not related to this thread.

    Hi Guys,

    I've just returned from holiday yesterday after after 2 weeks away and have received a Notice of Allocation dated 16th June. It says the claim is allocated to Small Claims Track and claim will be heard on 9th February 2023.

    It further goes on on to say that each party must deliver to the other party and to the court copies of documents on which I intend to rely on at the hearing and must do so by 14th July.

    Can i get some help on this, as this one will be sorted in court now.

    Are the copies to be emailed or posted?
    Evidence such as photos am I expected to send physical photos or will paper photocopies be fine?
    Is there a link with all the info I need to send to court and claimant and how to do this?

    Any assistance is appreciated

    Not sure what else you need to know that isn't already covered in the NEWBIES thread second post about Witness Statement stage?

    That's the resource.  Tells you everything about every stage.  The only thing NOT to do is read the old example WS that is still there, by RobertCox.

    We have newer and better examples in 2022, so after you have read the WS and evidence section of the NEWBIES thread, go and then look at the WS bundles shown by @wobs2k and @aphex007 etc.

  • When sending the defence to court and parking firm is it best to use email or post.

    If email, can the defence be sent to the CCBC email or does it have to be sent to the local court email address (If i can find one)?

    You aren't at defence stage and are no longer dealing with the CCBC 'admin centre'. You are now late sending your all-important WS and evidence to court and the other side, if this date is right:

    Yes, just Google it or phone the court to check the email.  As seen in any other court claim thread, the bundle needs to go to your local court and copied to the other side's solicitor.

    Hopefully they will now try to ring you, thinking they can persuade you to 'settle' ...and when you say no, a discontinuance often follows.

    Just had an email from DCB Legal saying their client has instructed them to discontinue Court proceedings and close the file. They have also sent an attachment of Claimant’s N279 Notice of Discontinuance.

    What a waste of your time this was, and why should there be such a litigation culture in parking?   It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it? 

    Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture. 

    There will be one window of opportunity later this year.  My best guess is in October.

    Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.

    The PPC money-grabbers have blocked the new Code by filing for Judicial Reviews.  Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.

    It is all on hold. This year will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.

    We need high numbers of real victims to make a point of responding to this final Consultation.
