I didn't suggest (or mean to suggest) that you remove the existing paragraph 6 and replace it with the new paragraph 6, but to ADD the new one after paragraph 5, call it 6 and renumber the rest of the paragraphs.2

Thanks. I have updated as advised and included the existing paragraph 6 and added the the new paragraph and renumbered the rest of the paragraphs.

Just ensure you get an automated email acknowledgement by return and you should be OK.4 -
@KeithP I have already sent the defence now. I ended up sending it twice as the first time I forgot to add the attachment. Received acknowledgements for both emails.
would you recommend to send again during working hours or leave it as it is now?0 -
If you have received the auto reply acknowledgement you should be fine, just check your MCOL status on Monday/Tuesday and see that your defence has been received.2

Have received a letter from HM Courts & Tribunal Service acknowledging receipt of my defence on 21st February.
Also mentions claimant must contact the court within 28 days after receiving a copy of my defence. After that period the claim will be stayed (Does this mean no further action will be taken if claimant does not respond?). Currently been about 17 days since I submitted my defence.
No DQ received from CBBC yet.

That's standard. Weren't you expecting it?The CCBC sent you a letter saying the Claimant had twenty eight days to consider your Defence.What you don't know is when the CCBC sent a copy of your Defence to the Claimant.It follows from that that it is not known when the Claimant has to respond to the CCBC.Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course?2

Latest Update. I have received a letter from UKPC solicitors dated a few days ago advising claimant wishes to proceed with the claim. They have also enclosed a copy of Claimants DQ form.
The letter then goes onto to state "that in order to assist court in achieving it overriding objective, claimant may be prepared to settle this case. In the event I wish to discuss settlement, requested I call them within 7 days and make reference to the correspondence they have sent."
I have no plans for a settlement, happy to go to court now i'm this far.
I have checked the MCOL claim history and its not showing CCBC has sent a DQ to me. Last update is from a month ago advising my defence has been received.
I will wait a few days now to see if CCBC sends me DQ form, if not I will download one from the internet and send it the CCBC via email and also a copy to the claimants solicitor.2
