So, what should 'newbies' hang their hat on?0
-
The judge on March 10th hanged his hat on it as he dismissed a case based on VCS' inability to prove the land was private.0

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Some people on here may have offered some assistance, but I wouldn't be able to say for sure.0

All the usual stuff that's been winning for many years on here and on pepipoo:
- The fact that these roads are public highway and fall under the TMA (similar to what you are saying but my worry is that newbies are reading these threads and thinking they can just say ''it's fraud'' and ''it's not private land''). We've been using this defence point successfully for a very long time re Airports, but newbies have to understand what they are saying.
- The fact that it seems as if there is no current landowner authority.
- The crappy signs.
- Some cases are caught in areas that fall outside of the enforcement area.
- Lack of keeper liability.
- Enhanced claim with exaggerated costs.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'm not privy to any detail other than VCS lost the case because they could not prove aurhority to act on the land. The defendant has stated on here they would post a redacted version of the judgement when they themselves got it.0

@chrisski961 is the poster who claimed the win against VCS. I and some others with similar cases requested further details but the thread appears to have gone cold and I also had no response to a PM.0

surely using the argument of lack of authority on the land is another weapon in the arsenal to use alongside the tried and tested0

It is the entire case.0
