  • I'm on the same side, but there are others here who appear to be of the opinion they are more equal than others. I personally won't put up with that. I won't be ridiculed or spoken down to by people who haven't a clue who I am or what my background is.

    If my MP judges the evidence of VCS' practice as 'illegal', then he will bring this to relevant government authorities. That he can't effect change remains to be seen. This is not a sprint. This will take time.

    I wouldnt say that some people on here see themselves ore equal than others, but one thing is that reply s on here can be blunt which can give the false impression of rudeness..
     One thing that no one wants is to see someone  miss fire an all be it well intentioned shot at the PPC industry and end up getting their fingers burnt .

    I fully support what you are doing; in fact we all love to see a robust fightback that involves MPs and real digging, as you've done.  We welcome posters who stick around to help others, which you are doing.

    But I just wanted to point out that the new Code does allow parking charges on byelaws land.  It's not private land but can have a PPC operating under contract law, as long as the terms reflect the byelaws, which take precedence.

    This has just been set out by Govt last month, and was all considered carefully with a huge amount of stakeholder and public consultation over 2 years.  This is the sort of response the DLUHC will give to your MP, I suspect.

    I am very glad your evidence has made your MP sit up and take notice (and that response is great) but I am worried new posters may start bandying the 'fraud' word around in court submissions which is a complete no-no, in my experience.

    I would be very, very cautious about accusing a PPC of fraud.  Look what happened in the Norma Wilshaw case, re costs.

  • VCS has NO contract to operate at LJLA. Therefore their attempts to get money is a false representation. That is fraud whichever angle you look at it from.

    On my claim form it clearly states " The claim is for breach of contract for breaching the terms and conditions set out on private land" . So I assume that if the land is not private and they are making the claim as stated then this is clearly false representation.
    So I suppose the the $64 million question is " Is this private land"

    I just don't see a Judge being interested in that.  Happy to be proved wrong but just a heads up to newbies not to hang their hats on the definition of private land.
