    I am going to follow the guidelines on here regarding saying NO to mediation, but can i just ask why this is so widely advised, is it some form of admitting guilt or is it the legal companies won't back down?

    How much do you think you owe them?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Hi Umkomaas, thanks for replying, they are asking for £571.72 for 2 Pcn's they say were issued in Aug. 2016 and Sept. 2016

    I was asking in the context of mediation - if you think you owe them something, how much would that be, then you have a starting point for mediation. It's rather a rhetorical question, because if you think you owe them nothing, then what's the point in subjecting yourself to mediation. Even if there was to be a bit of 'give' from the PPC, I don't think you'd get much change from £500. 

    Even if you lost in court, the judgment would be likely far less than the greedy-eyed amount the PPC are hoping to suck from you.

    Ah thankyou for that, i appreciate it and understand where you are coming from, my husband is dealing with it as i cannot do due to hypertension and stress levels, we are in our 70's and really do not need this stress, to try and sum in a nutshell, i have 100% proof i was not the driver with bank statements and holiday site bookings, we were touring Norfolk for 10 weeks on the dates they have stated, 2 sets of keys were left at our flat, neighbours were feeding our cat and letting her out and checking flat for us whilst we were away, son and daughter visited flat with friends at different times, i asked if they drove car whilst we were away, they said no, but stated was 5 n half years ago, maybe neighbours used car, i really cannot say, so i genuinely cannot say who drove car as no one had told us they drove the car. I did nothing wrong by leaving keys at flat as most normal people would have done, i hope that a judge on the day sees it that way with bank statements and holiday invoices

    Just download the N180 form and fill it in using the guidance by Bargepole etc , no to mediation

    If you have to sign it , sign a white piece of paper using black ink , take a picture of it and add it to the pdf as a digital signature

    eMail it to the ccbcaq email address and add a second email address , so CC the lawyers using their email address , so one email , 2 destinations ( there are 2 parties , the CCBC and the lawyers , dcb legal , that's it )

    No need to post any paperwork , email is normally ok , check for an auto generated email receipt from the CCBC after submission

    Your husband can act on your behalf as a lay representative on the day , plus can do all the admin for you as well , you just be as honest as you have been on here and both of you need to understand why you have no liability under the law called POFA 2012

    If you were to lose in court for 2 PCNs , the judgment is likely to be maybe £300 ish , not stupid figures like the claimant asked for

    You do both need to understand why the POFA 2012 has not been complied with and expect to have to explain Schedule 4  to a Judge.

    Never assume a Judge will know and spot fairly niche omissions in law but he/she will listen to you/your lay rep.  You need chapter and verse as to why 'keeper' liability does not apply or a Judge may assume it does.
