Hi, many thanks for your reply, Issue date on Claim Form is 24th. November 2021. Parking company are UKPC. DCB LEGAL letter of claim dated the 12th. October 2021 and DCB LEGAL on the 23rd. December stating the client intends to proceed with legal action, Sandra

Seeing as you have already submitted the defence , copy and paste it below , word for word , so we can see it
Also , login to MCOL and copy and paste the claim history below , so we can see where it's at
As for UKPC DPO and the SAR , use as many of the following as possible in your SAR reply as proof of I D under the GDPR law to obtain all your data
A copy of the claim form
Copies of 2 recent redacted utility bills
A copy of the V5C if you still have it
You can add the VRM details of the vehicle they captured , plus the PCN references tooIf you are or were the registered keeper or keeper , say so
Do not provide copies of photo I D , so not your passport or driving licence
Ps , £570.72 is a ridiculous amount for 2 PCNs , so they have inflated the claim with spurious charges , not allowed2 -
DCBL don't issue PCNs!
Please have a good read of the Newbies Sticky at the top of this forum, which outlines what you need to do at each stage of the process.

It seems that dcb legal issued an LBC for 2 old PCNs on behalf of UKPC in October , followed by a Claim form in November , followed by the usual notification on receiving the defence , so I think this is at the SAR plus DQ stage , or awaiting a DQ N180 from the CCBC2 -
Hi, i am preparing to put together all the details you have asked for on here and really appreciate the help you have given me so far, i just received a reply from the SAR i requested from UKPC and in the copy they sent were these dates, i do not know how to post and copy things but my son is coming here the weekend and will probably know, i am in my 70's and not very computer literate sorry. First ticket issued on 8th. August 2016, a letter was then sent and stated " this is not a circular" on the 9th. September 2016, then a final reminder was sent on the 26th. September 2016. The second ticket it states was issued on the 19th. September 2016, a letter was sent on the 21st. October and a final reminder was sent on the 7th. Of November. I am oblivious of ever receiving such letters as was 5 years 5 months ago. Could i please ask were the times between the dates of tickets being issued and the supposed letters they state were sent out, were within their time limits for them to do so? The tickets shown in the photos they have sent ( which when my son calls at the weekend i will get him to forward on here) were windscreen tickets, many thanks sandra Ps.I have 100% proof i was definitely not the driver of the car on dates shown, i was the registered keeper and trying to find out who drove the car at the said times.0

They have 6 years to issue a claim. Some Parking Companies are getting desperate and going back to old claims to frighten people into paying. Sounds like you should be able to build a good defence3

Thankyou Not_a_hope, appreciate your help, it is just somewhere i read after the ticket is issued they have to send out within a time frame the Pcn Notice, which in this case from ticket issue to letter notifying of the Pcn on both times were 32 days, i don't know if that is okay for them to take that long to send out, thanks Sandra0

There is a 9 year old law regarding holding a keeper liable for the actions of the driver whilst in their vehicle , called POFA , but it is not mandatory so many ignore it . POFA does not assist a keeper who was also the driver !
POFA requires 14 days if no windscreen PCN NTD , 29 to 56 days if a windscreen PCN NTD was issued
So 32 days is within 6 months , fails the 14 days test but could be within the NTD PCN test , if one was issued to the vehicle on the day ?
Complicated ? Yes , it can seem so , but if the keeper was also the driver then it means nothing1 -
That is OK on timeline as per Schedule 4 of the POFA..
But we'd like to see the 'not a circular' letters to check them for their wording. Some may be POFA-compliant for keeper liability and some might not.
We don't need to see the final reminder but I would just say what they have done with just 3 letters misses out one of the mandatory letters set in paragraph 24.4 of the BPA Code of Practice.
Worth mentioning in any defence. Doesn't make them void but all things you want the Judge to know, along with your proof of not driving and how rubbish (illegible and in overly high small text) UKPC signs are.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
