Oh well, going to go it alone, trust me i will win and get this dropped, i know what i am doing if anyone wants to come onboard!!!!
Hi, have been going through your thread.
Sadly. you will not get much sense from DCBL, But you do need to tell them some facts

1: Where did the fake add-ons come from, was it UKPC or the debt collector, probably DRP OR .. did DCBL add the fake.
As the debt collector offers a "no win no fee" service" and you did not pay, there is no charge to UKPC.  As UKPC instructed DCBL, adding a charge they did not pay is fraud
If they want to prove that UKPC paid a debt collector they must provide paperwork which they can't mainly because such a transaction probably never took place

2: You understand that these people are working from a code of practice written by the BPA which told parking companies they can add these fakes.
Who are the BPA in respect of the law .... nothing ...they are unregulated and this fake invention was by a BPA board member who runs a debt collection company called ZZPS ?
Therefore the BPA code of practice has no legal authority

However the new code of practice BANS these fake add-ons and that is THE LAW written by government.   You are dealing wih a cartel

Most Judges will dismiss the fake add-ons which are Double Recovery and that is against the rules of the County Court.  There are still some judges that fail to understand any of this so you must put all your points in the right order

Bear in mind that the BPA code of practice was written for the parking operators and the public actually has nothing to do with the code and certainly cannot be bound by it

Ponder this, after all I have said, a claim has to be signed as a statement of truth. A false claim can be deemed as contempt of court. Personally, I would bring this to the attention of the judge

All these points must be raised which needs a crib sheet so you don't forget anything.

It is our view that a judge will take notice of the facts that government has BANNED these fake charges as apposed to an unregulated code of practice

Let us know what the BPA say

I do hope that Coupon-mad or Red-x are not people you claim you are without, as they are brilliant, knowledgeable and helpful,
    Afraid you are absolutely correct!
Hopefully it is only a temporary "holiday".

OK, a bit of advice, don't knock members on here, we all have different views and MSE don't like it.

There must be something going on at Bpa
The simple fact is that if the BPA over the years had control over their members, the new government code of practice would probably never happened.
It is an industry in downfall and the BPA are right in saying that many of their members will go bust ... they will ,,, as they say ,, those who dealt it, now smell it

Patient-dream, do you think they will just make me pay the 2×£100 pcn charges then and not court costs etc. on the day once i submit all the details you have sent? Sandra
    Two thngs can only happen
You lose and you pay £200 plus court fees and solicitors fee, That assumes the judge takes off the fakes ,,, most will

You win and there is nothing to pay but you can ask the judge to award your costs.
That will depend on the judge but the average is £95
So, a cost schedule must be given to the court and if you wish, send it to DCBL

Ok, thankyou patient_ dream, and as Le_ kirk says i hope it is only temporary with Coupon-mad and Red-x for the groups sake, it is our first ever parking issue we have ever had and hopefully the last, lol, i never even drove the car, but that i know is irrelevant, i am also pleased with all the work my hubby has done, he has got a few people out of legal scrapes over the years and is very good at preparing letters and fact sheets, statements, etc.for people!!!! Will it work this time for us? Will have to wait and see i suppose!!!
OK, so just a tip ... judges work on facts and not stories
  • All done and dusted .. UKPC LOSE OUT ... DCBL LOSE OUT ... A Judge will be sad that he could not try out his new spanking stick.

And I'm sure you will know how to show your gratitude to your hubby

    Perfect result

Excellent result for you and Hubby.  Maybe he is just the sort of person we need as a volunteer on this site to help other posters; if he can get a log-in name of his own and start helping others that would be a double result.

As long as he doesn't continue the trend of posting disjointed images.   ;)

Well done for winning, and a pat on the back for your hubby for his fighting instincts. Did you get anywhere with Watchdog?  I also have an axe to grind with DCB legal, and if the tv people are interested in your story, I might be able to add to it
