Had a letter arrive 3 days ago that has left me confused:
Date 11th Feb 2022
IT IS ORDERED THAT
Unless the Defendant files the DQ within 7 days of the date of this order, the Defence shall be struck out and the Claimant shall be entitled to enter judgement for the Claim and the costs the Claimant has incurred.
I sent the DQ by email on 19/01/22 to ccbcaq@justice.gov.uk
Have I made a monumental error somewhere?

Did you get an auto-response when you did this previously? Either way, forward the original email with the DQ, and add a note to the email that you had complied originally with the court requirements, and that it was a fault with the CCBC processing.

Did that letter come from the CCBC? If so, I'd call them and ask them to urgently check their files, but as a belt and braces job, download an online N180, get it completed and send again. You've got to keep right on top of this as the clock is ticking dangerously, especially with the court threatening that the Claimant will be entitled to claim costs - which can be significant if unreasonable behaviour is proven against the Defendant, this includes failure to follow court orders. However, thinking further, isn't this case relating to your counterclaim? If so, are you the Claimant or the Defendant - I'm not sure? That might put a different slant on things. You need to get this sorted urgently, whichever. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes it did come from them. Will call them in the morning for sure.Umkomaas said:Did that letter come from the CCBC? You say to send the N180 again... I've just forwarded it by email. Are you saying to physically post it too?
I had the same thought RE claim vs counterclaim. The letter lists UKPC as the Claimant and myself as the Defendant so I figured it relates to the claim not the CC0 -
You say to send the N180 again... I've just forwarded it by email. Are you saying to physically post it too?No, email it.It's really confusing (not your fault) about who is who when a counterclaim is made. You do need to get to the bottom as to whom that Order applies, you or the PPC.Please note, we are not a legal advice forum. Spoke to CCBC. They have asked me to resend the DQ along with the auto reply mail from the 19th Jan in an attachment.
They also advised me to contact Reading CC to determine if the DQ was meant to go there instead of the CCBC0 -
You can no longer contact Reading County Court directly , like a few other courts they use a centralised telephone system which makes it a pain in the *** to get through to the right people. There is often a long queue time on the phone. It is really disliked in the legal profession as you cant make a quick call to listings etcJams91 said:Spoke to CCBC.
