    With the benefit of prior experience, I'm not fazed by the trip to court. It was easy last time, the Judge did most the talking for me.

    It's the paperwork process that I don't like... researching, drafting, posting on here, such a drag on my time for something I don't enjoy much.

    I think it's no actual goodwill.... they have realised on consideration that they can not win them.

    However there is one final PCN (car #1 back in 2017) for it not being parked within the marked bays that they won't cancel. (the car park bays weren't actually painted until 2019 meaning it was near impossible to make out which bay is which).


    Hi, I'm in similar same boat as you (a couple PCNs in my own parking bay and one from 2017 which they are taking me to court over and I've submitted defence for).

    Out of interest, what approach did you take when contacting your MA / UKPC? Any advise for wording to use on comms to them would be much appreciated.

    Eurgh, horrid isn't it. So I had the benefit of already beating them in court back in 2018 which gave me a bit more weight in the argument. Here's my mail to the MA:

    Mail 1:

    Hi K,

     

    I hope you are doing well. I am contacting you because I am being harassed by UKPC who enforce the parking at XYZ.

     

    For context they took me to court back in 2018 over a car (reg ZZZZ) that I parked in 2016/2017 without a permit. The judge ruled that I had the right to park there without a permit thanks to my lease. (Judgement attached for proof).

     

    Unbelievably UKPC have started another court case (using a different legal firm to last time) with me over another car (reg YYYY) also parked without a permit back in 2017. I have reached out directly to UKPC to insist that they desist, as I am a resident and it has already been ruled that I don't need a permit there. It is very stressful for me to be dealing with again.

     

    It would be helpful if as the Managing Agents who instructed UKPC, you could also reach out to them and insist that they drop any PCNs/ court cases where I am the registered keeper of the car.

    MA then came back with some gutless reply so I became more forceful.

    Mail 2:

    Hi K,

    In my previous court case UKPC shared their contract with Firstport and the latter have the right to ask UKPC to cancel up to 10% of issued PCNs. As the managing agents for the block of flats that I have lived in for 6 years and paid my service charge accordingly, I must insist that you leverage that ability to cancel my PCNs.

    The registered keeper address for all cars is one within the block of flats so it should be quite clear to UKPC that they are pursuing a resident. It's already been ruled in court that I don't need a permit to park here. Please do the right thing for one of your customers and exercise your right to cancel these PCNs.

    Reading between the lines, the MA then spoke to UKPC who gave this matter a bit more thought. Within a few hours I had a reply back from the separate thread where I reached out to someone at UKPC directly (happy to share this too if you need it?) saying she was going to cancel the PCNs. I suspect the PCN cancellations were more due to realising they can't win in court against me, than the pressure from the MA.

    1.       Your client is able to refund the £50 counterclaim fee that I have paid

    2.       That your client is able to provide me with written assurance that they are no outstanding PCNs or charges associated with car registrations: XXX, YYY, ZZZ at ABC 123 postcode and that no future claims will arise from any historical charges. I stipulate that this is from the head of litigation at UKPC and addressed to my name and address.

    @Jams91 Thanks and yes, total pain and they’re very sneaky to send it through just before Christmas!

    I’ll send a strong email to both MA and UKPC and see what comes of it as tbh I could do with not wasting anymore time on this even though I have a very strong case as literally the lease clearly shows that it’s my space and my defence is primarily focussed on primacy on contract.

    You need to make it timebound.  To be paid to you by cheque within ten days, maybe?

    Otherwise you are saying you'll discontinue if they pay your £50 in 3 years time, etc.

    You also need to state that UKPC must confirm that you have no liability for THEIR costs.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
