The forum over the past couple of years has become much more 'hair-trigger' in not only deleting posts and threads, but many bans (temporary and permanent) have been meted out, even to long term forum stalwarts. There are also issues around convictions and the time limit before they are deemed 'spent'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

A letter posted first class is presumed, in law, to have been delivered by the second business day after posting.eric4395 said:Certainly plenty advise and information on here and a lot of reading, but as I asked in my previous post how can they even prove they were delivered to your address as they were not sent by registered post.
The onus is on the addressee to prove they didn't receive it, not the other way around.- known as a rebuttable presumption.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.7 -
AS mentioned above , all they need to do is provide proof of posting to the correct address obtained by a DVLA lookup or provided by the keeper , or lease or hire company , or similareric4395 said:Certainly plenty advise and information on here and a lot of reading, but as I asked in my previous post how can they even prove they were delivered to your address as they were not sent by registered post.
Proof of receipt is not required , recently we have had cases struck out due to not showing proof of posting , in court , to a judge !
There are many misconceptions by people in Scotland , this will be their downfall after summer 2022 !!
We people in England and Wales have had 10 years head start !
I bet Carly Mackie rued her day in court in Scotland , due to parking on private property and ignoring the letters

The only car park that I have been impressed with where a householder has turned part of their land into a car park near Rugeley Trent Valley Station. The pens and envelopes are in the green telephone box. You just put the required amount in an envelope, write your registration number on the envelope and post it in a box. No PPC is involved and there are no white lines or terms and conditions other than paying the £4.00. It's a daily rate but if you wanted longer I am sure that you could sort something out.Umkomaas said:

I did wonder why the lady who helped the disabled couple did not champion the mutiple amputee veteran who was taken to court by VCS. I would have liked to see that case get a mention. I did also wonder which PPC's she was referring to when she said that some were very understanding.
It's not a bad daily rate for a main line station.

Interesting to see they mentioned and interviewed David Carrod.
Based on a Google search his firm doesn’t seem too popular and even now says “Permanently Closed”.
EDIT: Mistake on my part. Apologies for the incorrect information. I was highly impressed by David on the programme and a search to find out more led me to incorrect information.0 -
Really? Trustpilot says otherwise and it would be fair to let @bargepole reply.
Any problem with the rest of the show or what people like me and David and all the regulars here do? Got an opinion about private parking?
Always happy to discuss views and experiences but don't single people out.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Permanently closed??? It's not even temporarily closed. I'm still catching up with the flood of enquiries that came in since the programme was broadcast.*Steevo* said:Interesting to see they mentioned and interviewed David Carrod.

The usual slew of highly suspect court claims issued, and people asking for help with defences, representation, etc. I'll be looking forward to sending the parking company advocates away from court hearings with their tails between their legs.

I saw this programme which was very helpful. I didn’t realise that people on the programme were contributors on this board. Very impressed and huge congrats to them for all their hard work and knowledge!I have never received either type of PCN,however, what struck me is that the driver bears responsibility so if I ever receive one what is stopping me from making up a driver name and address i.e John Smith ( or foreign name) , 1, High Street, Paris/Barcelona or wherever??Anyway,Coupon Mad, Bargepole et al many thanks for all you assistance to so many folks on here and elsewhere..from a long time member of this forum2

so if I ever receive one what is stopping me from making up a driver name and address i.e John Smith ( or foreign name) , 1, High Street, Paris/Barcelona or wherever??If the PPC complies with the Protection of Freedoms Act 2012 (Schedule 4), they have no need to pursue the driver - the keeper can be held liable. But, they'd be required to first follow your identification lead but would likely return to you if the lead could not be followed. In the case of them pursuing you to court, perhaps you'd be able to prove to the Judge that you did in fact provide them with truthful and legitimate information. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Look, currently the PPC does not know who the driver is, hence they can only get details of the registered keeper.from the DVLA.Inforapennyinforapound said:I saw this programme which was very helpful. You could do what you say but if it went to court, you as the reigstered keeper would have to answer to the Judge ..... NOBODY SHOULD EVER NAME THE DRIVER unless you can prove he/she resides in another country.
Nice thinking but full of problems.
