GDPR (or equivalent) claim. Where they illegally retrieved my data from the DVLA.
Why do you think they were wrong to ask the DVLA for the keeper's details?

They are allowed to ask for the keeper's details simply to ask the keeper who was driving.
Because there is no valid charge to pursue from the keeper.
    Please read my second sentence.
    Here it is again...
They are allowed to ask for the keeper's details simply to ask the keeper who was driving.

    With no legitimate interest?
Obviously we will all agree with your use of the words 'legitimate interest', but the fact remains, and the DVLA will confirm it in their reply to you that they have to supply the information to anyone having reasonable cause.

I predict a quote from their reply will look like...
Regulation 27 of the Road Vehicles (Registration and Licensing) Regulations 2002 provides for the release of information to the police, to local authorities for purposes connected with the investigation of an offence or decriminalised parking contravention, and to anyone who can demonstrate ‘reasonable cause’ to have it.

DVLA considers that for landowners, or their agents, to take action against vehicles that contravene parking restrictions, trespass on private land or for the removal of vehicles abandoned on their land is reasonable cause to release information.

    We get that.

But we've never seen UKPC issue NTKs  for 'no permit' in a free car park with no permit rules.  Unheard of.  Are you sure?

Can you show us the place on Google Streetview and a scan of the PCN or NTK, redacting your name and address and VRM?

I have a couple, but I'll just show one. Anyway, won't bother doing anything beyond a standard defence.

Weird, unless there is a staff permit area within.  Another pic from 2019 here:

  • I would like to be able to present evidence like photos, copies of prior communication etc. Does this need to be provided at the defence stage? Thanks

    I don't !

Check your MCOL claim history every few days , ensuring that your defence is logged ( did you receive the email auto receipt from the CCBC ? ) , Once it's been logged they will send it to the claimant , who could take. While to proceed , so keep checking MCOL claim history until your DQ is showing as posted to you , because you are following the 12 numbered steps by coupon mad located in the defence template post

Expect the DQ in about 6 to 10 weeks ! Not soon
  • Surprised to see the online portal updated so quickly, but says the defence has been received.

Got the usual, they wish to proceed letter and their DQ. Interesting they haven't submitted to MCOL yet, unless they post it out.

Gonna have to actually start planning for a hearing.
  • No sign of DQ. Any phone number I can call on Monday to see if I can press for the claim to be stayed in case they haven't actually responded to the CCBC on time.
