Hi All
I have sent my reply to VCS , one last question while i wait for my reply , i noticed in the thread about how to reply to the LBC that it mentions it may be worth contacting the land owner or retailer to complain direct. Does anyone know off the top of their heads who owns these approach roads to John Lennon Airport ? I seem to recall seeing it was Peel Holdings but just wanted to check incase i send an angry email to the completely wrong place.
Thanks

In 2016 Peel Holdings was the landowner but my complaint letter received a useless response from Liverpool Airport customer service. Landowner contact works in a lot of cases but I fear you will be lucky to get any change out of Peel Holdings.3

Hi All,
Could really do with some more help. I have just received a claim form in the post so looks like this one is getting taken to court. It has various sections that it says i need to fill in and send back within 14 days from the day of service ( which is 30th January) basically it is is asking if i admit the offence , admit part of it or disagree with it , really not sure which parts to fill in as i have previously admitted it was the wife who stopped but she only did so due to medical grounds concerning our granddaughter who had a cleft palate and had vomited on the journey.
Obviously i want to contend the claim as i think it is unfair given the circumstances at the time.
Would i be correct in thinking i should fill out the section saying i dispute the whole claim and also fill in the acknowledgement of service section that says i can have 28 days rather than 14 to prepare my defence ?
Do i need to send proof of my Granddaughters medical condition at the time as part of my defence , or will i have another opportunity to submit this sort of stuff to back up my claim.
And will i have to actually attend the court for this as they have this down as being in the County Court Business Centre in Northampton which is over 2.5 hours from me , i would of thought that as the offence was in the North West and i live in the North West that it would of been in a court locally , or can i request it be dealt with by a local county court ?
Any help would be appreciated
Thanks0 -
Did you miss all the advice in the NEWBIE sticky telling you about the CCBC being a business and admin centre and you get to choose your own court part way through the process? Did you read the part about doing the AoS on line through MCOL so there is no need to fill in any paperwork. There is a step-through guide to completing the AoS. What is the date of issue of your N1 claim form? If you let us know then ne of the regulars @KeithP will be along with some deadlines for you and a link to the standard defence template.

Hi Le_Kirk
I haven't come across the parts that you mention above yet as i only received the letter on Saturday morning. If i'm honest i have been trying to concentrate on each section as they come through as i am finding it quite hard to keep up with all the information available and don't want to get ahead of myself and confuse myself further , so i last dealt with the LBC parts and requesting the SOR which i received showing photos and copies of letters sent etc. I will do some more reading this evening on the sections you mention .
The date of issue on the claim form is 25th Jan and says the date of service is 5 days from said date , so i believe i have til 14th of Feb to respond. I just wanted to check i am doing things in the correct order as i don't want to mess things up so far down the line. This legal stuff is all very alien to me and if i'm honest i'm finding the whole episode quite daunting.
Thanks for your help.
Regards

Do the AOS online today , following the advice in the second post in the newbies FAQ sticky thread near the top of the forum in announcements , following the guide exactly , do not touch the start Defence section on there
Email a SAR to the DPO at VCS and attach a copy of the claim form as proof of I D under the GDPR law to obtain all your data
Then read the defence template post by coupon mad in announcements , read it several times , then read a dozen recent VCS JLA court claim cases on here , get to know the topic and what to do with paragraphs 2 and 3 , then post your 2 and 3 below , for critique
No evidence is submitted with the defence , none at all !
Nobody is going to Northampton , you choose your nearest local court , even if the hearing is by telephone or video link on the day
Mine would probably be Manchester for example3 -
Hi RedX
Thanks for your advice , i submitted a SAR to VCS last year and received a copy of the Photos , letters sent etc. At the time i sent it i hadn't had anything from any legal company but just after i sent the SAR to VCS i then got a letter from Elms Legal saying they were acting on their behalf. Should i have sent a request to Elms too as i didn't at the time because i had already requested it from Vcs and received a response from them.0 -
The CCBC is not a court. The hrearing is likely to be by phone. It is all explained in the newbies, which you should read before going any further. Hav e you complained to your MP? Have you read any other airport threads? Is the place the event took place covered by bye-laws?You never know how far you can go until you go too far.2

I see you have had further advice from @Redx so follow that but you don't need to send a SAR to Elms, they won't know anything.Rileymark1 said:Hi RedX
