Hi All
I put a post up in November 2019 after receiving a penalty charge when my wife stopped to pick me up at John Lennon Airport. The thread has since been closed but i have recently started getting the threatening letters again after quite a while.
Basically i had been working in France and had flew home to see the family , wife was on her way to collect me when our granddaughter who had a medical condition at the time vomited in the car , due to her having a cleft palate she had issues with chocking so in a panic my wife just pulled up for two seconds while i jumped in.
Got the initial letter and sent it back saying i wasn't driving and explained the situation to them which the obviously decided to ignore. Then got loads of letters , bailiffs blah blah which i was told to keep ignoring then they stopped for ages ( maybe due to covid ) Then on 30th of July i got a letter from Direct Collection Bailiffs saying Final notice of Debt Recovery which i again ignored.
It has now gone back to Vehicle control services who have sent me a letter titled Letter before claim, basically says this issue has been passed to their Legal Department .
The letter basically says if i don't pay by 24/10/2021 they will have no option but to commence legal action, goes on to say this and that could be added to the total , then goes on to say if they get a ccj against me it will affect my credit etc, i know from previous advice on here that they cant get a ccj and only the court can do this IF i don't pay the money were they to win in court.
From previous advice i think this is another one that should just be ignored , but i just wanted to check as this letter has come with citizens advice forms and a couple of other financial looking letters with it.
Any advice would be really appreciated, this has gone beyond the money now. I don't have a problem financially but just feel ive come this far i may as well fight it to the end.

They always send the financial forms (it is part of the pre-action protocol) but you don't fill them in. You do go back to the NEWBIE sticky second post and see what advice it offers about what to do following receipt of a LBC.3

How is this a penalty? Have you read the newbies? Have you cmplained to your MP?You never know how far you can go until you go too far.1

As well as reading the 2nd post of the NEWBIES thread, search for and read at least ten 2021 threads about VCS AIRPORT claims.These cases are all the same and it will help you no end, to read accounts from people who are just ahead of you (any Airport).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks , i have just had a quick look and there seems to be loads more info from when i was last here pre covid . Whilst i spend some time reading and trying to get my head around other cases should i continue to ignore the letters until one comes that says they are actually commencing court proceedings ?

LBC stage is fully covered in the NEWBIES thread and hasn't changed since I last edited it ages ago.
It still says you should engage and tells you what to say as a bare minimum. There is no need to go off piste, the NEWBIES thread doesn't say to ignore a LBC.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi All
I have just found the email address for VCS from their data protection page so i am about to contact them to ask for the SAR following my reciept of a letter before claim.
I am just checking that at this stage that is all i have to do ( apart from continuing to read other cases)
My lbc said i had to reply by 24-10-2021 so am i right in assuming that as long as i have contacted them by email before then that i am still within my permitted time frame. The lbc had no email on it and said all correspondence should be by post.

I also noticed it said i could send one to the legal company too but i couldn't see anything on the letter saying who that was so i assume sending the reply to VCS will do for now .

Has that letter come directly from VCS? If so, then there is no 'legal company' involved.3 -
Sometimes it's Elms legal , but VCS have brought a lot back in house
So if no lawyers are involved , then follow the LBC stage advice which includes what KeithP said2
