    Why was a SAR sent to a solicitor?  
    Because Autosec didn't respond and it was suggested that the SAR instead be sent to DCB Legal asking them to get their client to abide by the law - DPA 2018.
  • They should have photos shouldn't they? I know that at the time the signage at car park was almost non existent and placed so that you didn't really see it until you were leaving. I will be relying on the photo evidence. Can I insist on seeing them?

    Exhibits are exchanged at the WS stage in a few months time , so that is the time for disclosures etc

    By all means elaborate on the SAR issues and lack of contract or pictures or documentation etc

    As for your entitlement , you are only entitled to your own data , nothing else ( GDPR )

    The post by Bargepole in the newbies FAQ sticky thread near the top of the forum in announcements , linked in the second post , tells you what happens and when ( he posted it several years ago ). It's about MCOL procedures , plus the wheels of justice turn very slowly

    The 12 numbered steps in the defence template thread by coupon mad also tells you about the stages

    It's no different for rent arrears , or non payment to a builder , it's court procedures etc , nothing to do with parking

    If you or anyone else has a live court claim and hasn't read this 2 pieces of advice , then you are on the back foot and doing yourself no favours !

    just a quick update:
    looks like another win for the team here, although I'm not sure if the last sentence means they can have another crack at me? any ideas?

    "DCBL write further to your email dated 19th October 2021. Thank you for confirming your details for data protection. Please note, DCBL are no longer instructed to recover the outstanding balance in relation to the unpaid Parking Charge Notice (PCN), reference xxxxxxx.

    DCBL have now closed the case and will not be pursuing this matter further.

    Should you receive any further correspondence regarding this matter from our client or another company, you would be required to respond accordingly".

    Hmm on the face of it, it seems like it is over however, it could be that DCBL have been sacked and the PPC are using another solicitor.  Probably wise to check with the PPC.

    i’ve had an email from DCBL this morning regarding my LBC - they are still acting for Autosec

    maybe they have seen the light

    “Please note, we are currently investigating this case. You will receive a response via email when we have concluded our investigations. I can confirm that your case is on hold and no action will be taken before you receive our response”
  • well this is very confusing. I have now received a letter from DCB Legal saying their client intends to proceed with the claim.
    attached is a Directions Questionnaire which I will ignore as per instructions on beginner's page.

    I think this is an underhanded trick as they sent me an email (as my above post) saying they have closed the file on the 2nd November and on the 8th November they write a letter saying they are going ahead with the claim. Do they hope people will throw away their paperwork so they will be caught unawares? I don't get this.

    Sounds like this is about two different PCNs.  One at claim stage, one not.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
