No it's not applicable , that is for the LBC stage , before the court claim ! They will reject that request

They should reply regarding the SAR request on behalf of their client

I doubt that bay sentry are involved , especially if their name is not on the court claim
You're right, Baysentry seem to have appeared on the scene recently and I am sure there was a different sign on the site two years ago with AutoSec name on, which obviously have been replaced by the BaySentry sign as on the photo in my first post.

The claimant on the court claim is Auto Security Limited T/A Autosec.

  • Autosec no longer deal in direct parking enforcement and sold (Mar 2021) that portion of the business to BaySentry (BS). Since then are no longer members of BPA.
Your PCN was from Autosec, they are the claimant. Nothing to do with BS.
You will get no replies from Autosec wherever/however you send correspondence except ‘refer to DCBLegal.’

As (on here) you’ve admitted you were likely in the wrong, your defence is weak however all is not lost!

Even at this late stage I’d concentrate on asking DCBLegal for written proof of authority between landowners and AS to issue PCN.  Ask DCBLegal for everything Autosec have on you as they have purposefully obstructed attempts at contact. Ask for proof of appeals, photos of signage, correspondence to and from TNC, where they obtained your NTK details etc. Send SAR to DVLA, a quick email.
(Mine came back with nothing from or to TNC, so how did they obtain data?)

Was the signage ‘throughout’ carpark? Was signage attached to a listed building?  You can inbox me if you want email address of planning guy for that.  If it was Lister Court, ask @hullensien

Have you written to landowners?  They could possibly help, although if you parked without authority, ignored PCN.  Anyway it’s worth a pleasant distressed letter but possibly too late at this stage, that’s why I would go down the paperwork route... hopefully AS won’t prove helpful and DCBlegal will pull out to save looking foolish by association.

Contact your MP (is is Emma Hardy or Diana Johnson?) most in the area are being bombarded with constituent complaints right now, so they are aware of Del Grosso and Autosec.

Hopefully at worst you may have to pay something but not more than the original £100, at best they pull out.

I was recently talking to a woman who watched him tow a car away with a dog inside, that’s the kind of man we are dealing with.

  • You could try info@autosec.co for the SAR (not .co.uk) but the chances that if they reply they will point you at their abysmal payment portal for evidence. They say they can't reproduce the PCN and seem to have a shredder beneath their letter box. Don't expect anything from them.
I kept pushing (see my thread) and they refused to correspond, referring me to DCB Legal.

Thanks Voyeurmse some good advise which I'll follow.
No it wasn't Lister Court, it was Saville court behind Saville road. There's only one sign to my knowledge but I'll check when I go into town today.
I must admit I was being foolish parking there when I could have parked anywhere in town "free" on that day and I have a HDM newspaper clip as proof, with the dates when all car parks will be free during Chritmas period.

One question; my MP is Andy Percy but I believe it is in Diana Johnson's constituency. Would I write to her or Andy P?

Yes it seems that way, I think I will put pressure on DCB Legal as I'm getting no joy from Autosec (pardon the pun but I just can't imagine the word joy being in the same sentence as del grosso!)

I assume then you live over the bridge if Andy Percy is your MP
If so I would write to both
Firstly because Andy Percy is your MP
Secondly because it happened in Emma Hardy’s backyard
