just a quick update the court has passed our defence over to the parking company and have been told they might contact us but if they dont they have 28 days to contact the courts if they wish to proceed if not the claim will be stayed

Stayed? Why would it be stayed? Surely it should be struck out? (If the C doesn't follow the process to move the claim forward to a hearing then surely they shouldn't be able to get a 2nd bite at the cherry).Jenni x2

Stayed is standard but they will proceed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

just had a letter today saying they are going to proceed but if i phone them in the next 7 days they say they can settle the case between us ,they also enclosed a copy of the courts questionnaire which they have filled in .couple of qusetions will the court send me one and the frist question is do you agree to this case being referred to the small claims mediation service they have said yes should i agree .the rest is quite straight forward

There is no court allocated at this stage , just the CCBC in Northampton !
No idea why you think it's a court letter that arrives in the post ?
Read the 12 steps in the defence template thread , because it's clear that you are not following them , or the what happens when post by Bargepole either
Ignore the DQ sent by the claimant , check your MCOL claim history to see if the CCBC have posted the DQ yet , and follow the 12 steps closely3 -

Question 1) was , will the court send me one ? Question 2) was about mediation , the 5 year old Bargepole guide tells you what to do with a DQ N180 form from the CCBC

can anyone tell me if this is a real letter from the court if so is there anything i can do about it we already have a case ongoing in this thread and didnt know they could open another case against you for parking in the same carpark before they had sorted the first one out so we thought the letters we were getting for this new case were just some automated letter they sent out
